    I wouldn't hold your breath, Monarch have refused my claim and despite my email back saying if they don't reconsider I will take legal action they have gone exceeding quiet. I'd like to think they are writing out a cheque but my guess is they have no intention of doing so.

    I'd try the Emirates website and see if they have a UK based office. I would also suggest snail mail, possibly recorded. My first email to Monarch went unanswered and it wasn't until I wrote a letter that I had a response.

    Hi i recently wrote a letter to Thomas cook about an 11 hour delay from dalaman to Manchester in august last year and received a letter back saying because i didn't complain within 28 days they were unable to investigate the claims.
    So i then sent a letter to the CAA and have received another letter off Thomas cook this morning and they're now claiming extraordinary circumstances. We were delayed because when the pilot landed the plane in dalaman he came in to quick and it blew a hole in the wing, at first they said we would get vouchers for food but we weren't given any and we were stuck in the airport from about 2.30pm till 8.30pm, they then decided to take us to a hotel nearby for food and drink till 02.00am then back to the airport and check in all over again finally taking off just after 05.00am. Where do i stand with them claiming extraordinary circumstances and where should i go from here?
    Any help greatly appreciated.
  • Hi i have just sent a letter asking for a refund to ryanair for my delayed flight to fuerteventura last april for 3 hours 55 minutes, i will keep you all posted as to the outcome

    After applying for compensation for my flight being delayed a few years back I have now been offered compensation by Easyjet. They have emailed me and asked for the last 4 digits of my new banking card and said they would ring me for my new banking card details. The email is in quite bad english though and I have emailed back to say that I would rather just be issued a cheque as I am not happy giving my banking details over the phone. The email I've received has got the flight reference on so I'm not sure how it could be someone trying to defraud me but I just dont feel comfortable with the english being poor and with giving my details. They said they are going to speak to the finance team and get back to me. Has anyone else experienced this from easyjet and if anyone else has had compensation from easyjet then how has this been paid?

    Since it's Ryanair, I can tell you the outcome right now. They will tell you that 'extraordinary circumstances' mean they don't have to pay you anything.

    Give them 14 days to agree your compensation and then sue them under the European Small Claims Procedure - Form A - issued in your local county court and served on Ryanair at Dublin Airport.

    I did the form to Monarch with all details etc a few weeks back. Today i had this mail:

    25/02/2013

    Dear Mr XXXXXXXX,

    Re: Flight MON313 Cardiff to Sanford on 18th September 2008

    Further to your claim for delay compensation, we are writing to advise of our conclusion.

    Providing our passengers with a safe and efficient service is our first priority. We would like to reassure you that every reasonable effort is made to ensure that Monarch Airlines flights depart on time and in the unlikely event we are unable to do so through disruption, we aim to provide a solution at the earliest opportunity.

    As previously advised, in some circumstances passengers may be entitled to compensation for such disruption under European Union laws. However, any monetary payments are subject to certain criteria being satisfied. Under these laws where the disruption is caused by an ‘extraordinary circumstance’ which the airline was reasonably unable to prevent, the carrier is not obliged to pay compensation. Extraordinary circumstances have been defined by the courts and the European Regulations themselves provide a non-exhaustive list of which circumstances can indeed be categorised as extraordinary.

    Our records show that the aircraft scheduled to operate your flight suffered an engine fault and required rectification work in order to be safe to fly. Despite Monarch’s best efforts, a delay was caused to your flight.
    In order to reduce the length of the delay, passengers on your flight were transferred to the first available aircraft from within the Monarch fleet, and departed at the earliest opportunity once it had completed the previous flights it had been scheduled to operate.

    Having considered the factual background of this incident, we are satisfied that the disruption in your case was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given.
