There are two points where you have to pay fees up front:
1) When issuing the summons (it's a sliding scale) (Google for county court fees to find the relevant leaflet)
2) If the summons is defended and you decide to pursue the matter to a hearing, then you pay a hearing fee up front (again on a sliding scale, depending on how much you are claiming)
These fees get added to the claim, and you get them back off the defendant if you win the case. (Providing you can make the defendant pay up!) (If you lose they are non refundable)
If the defendant wants to pay up before the hearing, it's up to the claimant to get everything owed before withdrawing the case.
Also if the case ends up in a hearing, the loser has to pay the winners costs for attending court, loss of income etc. This is dealt with by the judge at the end of the hearing.0 -
Is that 2 separate contracts or only 1 contract that has 2 missing claims?? Dear Sir or Madam,
I submitted two valid cashback claims to you via your cashback webform on your website on the 5th August 2010 just before 18:40, utilising the same process I have successfully used previously.
Your system failed to provide any feedback that the claims had been received therefore I emailed the claims to you on the 14th August 2010 at 19:21 stating that I would be taking further action if I had not received confirmation of my claim within 5 working days.
Your Terms and Conditions state:
1. “Once we have received a copy of your bill we will confirm receipt by email within 24 hours”
2. “It will then take up to 7 days to approve your claim and issue a cheque. You will be emailed once your claim is approved, and again when the cheque has been issued.”
You have failed to provide two valid cashbacks as well as failing to meet either of your own Terms and Conditions mentioned above therefore I am notifying you that I intend to make a claim through Money Claim Online unless I have received email notification that my claims have been processed and approved by 09:00 Tuesday 31st of August 2010.

well done! that's almost exactly the same as the email i sent.
i sent mine at night; the claim was acknowledged, authorised, and paid between 8.41 and 9.03 the following morning, and the cheque arrived 9 days later.
it seems they can act extremely efficiently, but only when they're being threatened.0 -
Fantastic WychWierd, that post will really help others and shows what is needed to get back the offered cashback deals - Mobiles.co.uk do need threatened and I would recommend doing it ASAP.

Whereas I agree with your sentiments 100%, given the amount of bad press and complaints (all warranted) against this dealer, it does no harm to comment positively when any positive changes are observed.
Let's hope Ferris actually gets his cashback cheque within a reasonable time.
( I should add that the first 2 payments on my friend's cashback have gone through ok as well )0 -

Why not let those of us you don't agree with just post without you feeling the need to pass a comment on the post.
Or (as previously suggested to you), why not just ignore our posts??
As far as your suggestion that "positive changes are observed", swallow/summer etc.
The uninitiated should be advised not to see this as a breakthrough and feel content they will be well treated by this company - and wait to see months of no problems before deciding they have reformed.0
