Having browsed thru this site, go to page 105 and look for oldskinflint he has kindly posted a refusal letter format that you may like to use. Also accept the banks offer as an interim payment, but make it clear that you will continue through courts to recover the full amount0 -
Suggest you ring your local court and speak to someone there, they will tell you what to next0

I rang Barclays litigation department today and spoke to the person who is dealing with my case. He said that it is currently Barclays' policy to settle all the cases out of court but that they are prioritising by court dates, so I should ring back when I have a date. Everyone I spoke to was really helpful, so it is definitely worth phoning the number on this thread once your court date has been allocated.0

Hi guys I'm new here I've read through a number of posts phew isn't there a lot but i'm stuck on what I do next
I received my statements from Barclays on the 39th day, using the calculater to work out interest I sent a claim in for £2070 + interest giving a total of £2597.24 I have received a letter saying that although they disagree with my claim that without any admissions of liability they are willing to offer me £1500. towards the total amount I am seeking, this is with the cost & inconvenience inherent in a further dispute in mind and is intended as a gesture of goodwill, in full & final settlement of my complaint. They then go on to say if I want to accept their offer to send the form back & the money will be in my account in 10 days. They say of I am disatified with their proposal for resolving my complaint I may ultimately be eligible to refer my complaint to the FOS.
I have just called them to negotiate telling them I will accept £2000 but the snotty woman sad it was a one off final offer & wasn't negotiable I told her I wasn't prepared to accept their offer & I would take the next step in claiming back my money. ... but what is my next step?

reading the letter again it does say as a gesture of goodwill, in full & final settlement of my complaint. Am I right in thinking that if I did accept this I couldn't take it any further as it doesn't mention it's a "part payment without prejudice" as I've read on other posts0

Hi, they all say goodwill gestures in full and final payment. You have to write back to the bank and tell them that you are accepting it as part payment without prejudice to your claim and that you will be persuing the claim via the court for the remainder of the money owed to you and then file your claim
Good luck

thanks for the reply ..
do I sign the form they enclosed with their letter although it does state " I accept the sum of £1500.00 in full & final settlement of my complaint with Barclays" adding "I am accepting it as part payment without prejudice to my claim and that I will be persuing the claim via the court for the remainder of the money owed to me" or do I send a different letter altogether?
also sorry for being thick but do I make my claim throught FOS or the County Court?0 -

I wouldn't sign it just send it back with the letter, then whichever route you take is up to you, you can go through either, if the bank have said a definate no then you can go through the finincial ombudsman, there is no charge via that route either. If you are claiming interest this can only be awarded by the courts,

Sorry send it back with which letter?I might go with the FOS as I'm happy to accept the charges without interest although my original letter was including interest
