  • Hi, we have just received a copy of barclays defence. The case is my mother v barclaycard. Does anyone have an e-mail address for the litigation dept? And does anyone know if its worth another try to settle this before court? Its just my mum has recently become unwell and im not sure this added stress is doing her any good. Thanks in advance x

    Just opened my mail folks and guess what...surprise surprise....my credit limit has been dropped 3 days after requesting statements!!!!!!

    Limit on 11th £1500 (for last 10 years+!!!)
    Letter sent 11th.
    Their letter dated 14th limit now £1250.

    Pathetic or what? But Hey, I don't even want or need it anymore so do I look bothered??

    Don't let them bully you guys...stay strong.

    There is no point in contacting Barclays till you get a court date! The litigation dept is over run and will not talk to you till that time.

    However, once you have a court date they will make you a better offer or enter into negotiations. It is possible to get 100% payout + Interest + Cost so stick to your guns!

    STILL waiting for the rest of my statements from Barclaycard,they are really dragging this out ,applied for them on 6th April,they sent from 2004,weeks ago , and when i ring them they just say i will have to wait. can i start to reclaim my charges from the statements i have,and reclaim the rest later,in effect have two claims OR should i wait until i have the whole 6 years of statements,then claim. ????

    Hi.
    If youve been waiting for your statements over 40 days, you need to contact Office Fair Trading and also Financial Obsubmen and report Barclaycard for not suppling the statemenst withit 40 days.

    Also it would be best to wait to you have all the statements, and just fileone claim,that way you are only dealing with the paperwork once, and all the relevant costs. The thing is you can still claim interest on the money outstanding.

    A4 envelope dropped through letterbox this morning, at last ,rest of my statements.. took over 10 weeks to get them.

    Hi guys,

    Just wanted a little advice from anyone who has suffered the same from Barclaycard.

    Sent my first letter about a week ago claiming back approx £870.00 inc interest. Got my statement and a letter back today saying the usual 'We have offered you the difference between the 'Charge' and the OFT 'Charge' guidlines. This amounts to about £234.00. Nicely, I am now £234 in credit on a Barclaycard I can't withdraw on in the UK...

    What is the best course of action now?

    Should I:
    • Write back, saying "Thanks for the part payment but unless you refund the full amount I'll be progressing the matter to SCC..."?
    • Or should I offer a figure for a settlement, say a further, £360, which I would be happy to settle for?
    The above relies on whether, they are likely to settle early to save themeselves a couple of hundred quid. Will they? How would they respond to a slightly altered second letter, advising them that I'm likely to win if it goes to Court?

    Also, can I touch the money on the car in the meantime? Does using it facilitate acceptance on my behalf?

    hi.
    You could write back and say thank you for the part payment, but I want xx more, they are very unlikely just to cough up any money, personally the route I took was refuse the money as I was asking for xx.xx and they only offered xx.xx, even after letters going back and forth, I have still had to issue cort proceedings.
    Apologies if this sounds brunt, its not meant o, just from personal experience.

    Basically as far as Barclaycard are concerned your just one of the millions of people that is threatening them with court action, and if you start the court fees you pay upfront first so it does not come out of there pocket. My claim is for £400.00 ish and that cost me £50.00 to bring.

    If you did continue with court action after accepting the money and / or spending it, then it does not really strengthen your case.

    Ive got a court hearing in July, and am fighting tooth and nail to get my money back.

    It comes down to take the money theyve offered, or refuse and start court proceedings.

    If they're unlikely to settle, I'll happily carry on. I was just a little concerned that if it goes to Court, the wrong Judge on the wrong day could say that I was being obstrusive in not settling earlier.

    I shall carry on regardless then with the second letter. Would it be fair to say, seeing as they have already credited the account, that I accept the part payment without prejudice (and leave the money there) and contiune on with the action?

    Hi.
    To be honest the money is a debatable point, with mine barclays credited the account without telling me, so I refused and they took it out, theres nothing to say dont accept it, and continue, saying the money is without prejudice, but if you go to court and get a dodgy judge who says youve had part payment, that should be sufficient, obviously its a devil and the deep blue sea situation.

    One thing I will say though, is be prepared for a long fight, mines been going on since August last yr, finally got a court hearing in July, but Ive only been allocated a 15 min slot, on a pre court hearing.
