Hi, I was just wondering if anyone had had any luck claiming back charges from credit cards?
I have a Natwest CC and a Egg one, and am pretty sure I will have some late payment fees on both of these, so wondered if worth pursing?
Also what letters and time frames do I use?0 -

Edinburghlass: You have the patience of a saint !!!!
I've been all over the site for the last few days gathering information and the sheer laziness of people is frankly, astonishing. You would think that people about to embark on a possibly court process would do their research properly and spend some time on it.
I cannot believe you have just answered a question that was asked and answered several times on the first page of this thread. For crying out loud people READ !!!!!!! Since a lot of the time the information is on the first page of a thread then no pathetic excuses about 'wading through pages of a thread'. Good grief !!!

Did Egg write to you with a 'bribary' letter? I requested they pay back £282.28 and have now received a letter of which point 2 states:
You allege that these charges are a penalty. You have put forward no evidence to support this allegation and we do not accept it. As explained in our previous letter, the charges set out in the Agreement are a genuine pre-estimate of the loss caused to Egg when a customer breaks the terms of their Agreement.
Point 3 then states:
You may have followed recent media cocverage of the OFT investigation into default charges. Following the conclusion of this investigation, the OFT indicated that it would not proceed further against Egg on the basis that Egg reduced its charges from £20 to £16. Without any admission in relation to the previous level of charges, Egg has reduced the charges accordingly. This reduction does not apply retrospectively, but in your case we are prepared, without any admission of lilability, to apply the reduction to the disputed charges. If this is acceptable to you, we will credit your account with a total of £28.00 (being £4 per default charge applied to your account, on the basis of 7 defaults).
And then the 'bribary' on point 5:
We would like to remind you that it is our policy to consider ending out Agreement with you if we feel that the bank/customer relationship has broken down, e.g. in the event of legal proceedings. If we do this, you will no longer be able to use your credit card but will still be liable to repay any balance on the account.
Can anyone give me an idea of what I should write back to them saying? I owe £1500 on the credit card so wonder if it's worth claiming this £282 - but it's MY money at the end of the day... isn't it?0 -

At which point has this letter been sent? If you're at the court stage, the laws you are relying on are specified in the Particulars of Claim. Sounds like Egg are stalling or trying to intimidate. You may have followed recent media cocverage of the OFT investigation into default charges. What rubbish. The OFT recommended £12 as the level they would not take action against the bank. This does not mean you cannot claim for the whole amount, so tell Egg unless they come up with a costs breakdown, you will claim for the whole charge. We would like to remind you that it is our policy to consider ending out Agreement with you if we feel that the bank/customer relationship has broken down, e.g. in the event of legal proceedings. Remind them closing accounts is frowned upon as a retaliatory measure by the Financial Ombudsman.0 -

Thank you so much for your reply. I was sent this letter in response to my request for charges. I had to keep chasing them up for a response and now I don't know what wording to put in a letter back to them. I don't have a problem normally with wording but since this is all legal terms I don't want to put something in that is incorrect, therefore stuffing up my claim and making myself look a total fool0 -
