Bank lost cheque and are denying ever having it.... Desperate and need help!

Hi all, hope you are well and someone out there can help me.

Two weeks ago I paid in serval large sum cheques into the bank over the counter to the cashier.
I was told that because they were so large they need to be triple checked. The cashier added them up three times and completed the paying in slip. She then took all the cheques plus paperwork to have them checked by two others.
I waited at the counter for 15 or so mins.
The cashier came out behind me..and called me into a room. I was told to take a seat and then questioned about the cheques, where they came from etc....I was then told that I should think about which account they should be deposited in and told of the different accounts the bank offered and what they all did...
I wasn't interested in any of this and only concerned about when the cheques would be in my account.
I spoke with a senior care person at the branch who told me that due to the bank holidays (Easter) etc. they would be a week, she then went around to the cashiers side and stamped my deposit receipt to confirm they had received the cheques, and the total they had received.
I then left.
A few days later I checked my account online and noticed that the cheques had been deposited but funds not available, this is what I would have expected...... BUT... the amount deposited was £10,000 less than I paid in.
I called their customer services and was told that due to the holidays and the fact that they were large amounts, there were other checks being done on the cheque and it would show in my account soon.
I waited until the day they were supposed to clear to check the account again... (1week after they were deposited.)
I called customer services again to double check where and what was happening...again I was told that as long as I had my receipt there wasn't a problem.
I explained that the missing cheque was for my car and the new buyer was coming to collect it. Twice on separate calls I was told the there wasn't a problem with the money and it was just goin through extra checks.
The buyer collected my car on Thursday.
Still unsure I called again just to double check. This time I was told they had no pending cheques in the system.. After being passed around to a few different people I was then advised to log a formal complaint. I did this and was assigned a senior complaints handler. They then took over the investigation and a complaint was investigated. I called every day twice a day till today.
The outcome I was told today was that after a full audit of the branch no money or cheques were out. All the monies added up.
The cashier and other staff were interviewed and found that it was just an error on part of the cashier who entered the incorrect amount.

I am so livid I have been shaking all day, I don't know what to do.
The bank has said that this is their final answer and that I should take it to the ombudsman.
I asked the person on the phone what they would do, I was told that I should contact the dvla and the police and report the car stolen.. I explained that it wasn't stolen, it was paid for, THEY LOST the cheque. I was then told to speak to citizens advice..

I feel my next move is to report this to the police as a crime, the bank have stolen my money.

Any suggestions/advice is greatly appreciated and thank you for taking the time to read this.

Have you asked the purchaser of your car whether the cheque has cleared his account?

Cheques can, and do, go missing during processing.

Why on earth would you let someone take your car away before a cheque was cleared? If it hasn't debited their account chances are it's lost somewhere and they won't know which account to match it up to.

First of all forget about the police. Save your and their time.

Can you contact the buyer and ask them to cancel the cheque and issue a new one? If they refuse, you can sue them, and £10K is the top amount for the Small Claims Court claim.

You can complain to Ombudsman, but IMO most likely you'll be awarded a compensation from the bank, not the full amount.

I amn't sure about suing the bank. Surely you should have waited until the cheques cleared fully before giving the car away.

Doesn't appear if any cheques have been lost.

This sounds like a major c... - up by the bank!! You need to escalate your complaint asap to the Ombudsman. Surely it will also be on the banks CCTV and will show the number of cheques that you handed to the Cashier and the Cashier handling the cheques.

But also you need to be very careful about accepting cheques from people you dont know as even after a cheque 'clears' it can still be recalled by the sender up to several months later. A payment directly to your bank account via bank transfer is a much safer and quicker option and once the funds credit your account they cannot be recalled by the sender.

It might be worth a shot to speak to the person that bought your car to see if they can cancel the seemingly lost cheque and write you a new one, or send the money to your account.
Hope u get it sorted, let us know what happens!

...but can be recalled by the bank if it turns out to be a payment from a hacked account. Maybe for a car it is less likely as the buyer can be traced (?).

Cash or a banker's draft seem to be the only safe ways nowadays.
  • The bank are saying that they never even received the £10,000 cheque.

I let the car go beacause I was told there wasn't a problem with the money by two different people in customer services.

I have asked about the cameras so they can check the amount of cheques and I was told that the cameras will only show that I was in the bank and not anything else in detail.

The cheques and the amount were checked three times in the branch and by a few staff and only now are they saying it was a mistake, it took head office over a a week before they could even get through to the branch.

I don't have the buyers details to contact him, he called me and I didn't think to take any details from him.

    Panicking is an understatement!
  • The cheque was a printed cheque... Does that mean it was a bankers draft?
