I feel my next move is to report this to the police as a crime, the bank have stolen my money.

No, it seems like the bank have lost a piece of paper.

It's not stolen until funds are transferred and from your post, it seems the cheque was never entered into the system.

Contact your buyer and ask for a replacement cheque. If they refuse, ask them to return the goods.

    What does your receipt say?
    ....the total they had received....

    ......................
The cheque was a printed cheque... Does that mean it was a bankers draft?
    Would this make any difference?

I love this about banks -

Here's your receipt for proof of deposit.
The deposit doesn't clear, or clears a different value.
So you give them your proof of deposit.
Then they say the cashier must have written down the wrong value.

    So your 'proof' means jack.
  • All the people I spoke with at the bank have said that the receipt is my proof, the total is three times the value of my car in 7 cheques.

I do not have the buyers details, I will have to contact the dvla to see if they can give them to me....but technically the buyer hasn't done anything wrong. The bank have.

I think that when the cashier got up to take the cheques and paperwork she must have dropped it, the bank say they do not have a photocopy of it... This implies it was lost very early on. I don't believe that they can take the word of the staff after the amount was checked numerous times by several staff for over 15mins...

I don't have the buyers details to contact him, he called me and I didn't think to take any details from him.

So you accepted a cheque for £10,000 from a stranger and let them drive away in the car. Not knowing if the funds would ever clear.

You are also accusing Lloyds of losing a cheque for £10,000. This cheque has never been processed.

Sorry but this sounds so totally implausible. Heard some stories in my 40 years in finance. This falls into the b******t category.

I suspect your receipt also lists an amount which is £10,000 short?

If that is the case, then the cheque was never processed by the cashier.

A photocopy of the cheque would also have been taken before the deposit was made.
  • I'm not sure if it's an admission by the bank but they have offered to compensate me for the cashier 'incorrectly writing the amount', calls, fuel to and from the branch and for their customer service guys telling me that my money was clearing in my account.
Why would they tell me that the money was there, and then tell me they never received the cheque?.

Why do you suspect this? The OP made it clear that the receipt shows the correct amount that is £10K bigger than was eventually credited to the account.
A photocopy of the cheque would also have been taken before the deposit was made.
Taken by whom and at what stage? I don't think that cashiers take photocopies of all cheques.
Personally, I would have made copies or taken photos myself (or used an ATM in the branch to deposit the cheques that provides a receipt with a copy).
  • ACTUALLY, the receipt shows the correct amount I paid in..

I let the car go 9 days after receiving payment, after i was told the money was clearing by customer services.
