    Parking ticketing LTD are still in existence according to companies house. Who told you it's changed and what evidence have they produced ?

    Two entirely different organisations, no link between either. Same as Tesco vacating a premises and Aldi taking it over.

    I'm not sure what your angle is on the 'change of name'? It's an entirely different contractor from what I see (but haven't read back over 60 posts from the past 7 months to refresh memory on the fine detail).

    They mean the signs changed in 2018 (one PPC left, another was installed) but their PCN is from the first firm, and the signs were correct at the time.

    So I am asking what their defence now relies on, if the right firm was on the signs in 2015 after all, what is going to win this at the rearranged hearing?

    Claimant is Parking ticketing LTD and the signs at the time were Parking ticketing LTD.

    The defence now is that we in fact had a permit issued for 2015/16. The permit was not displayed because the agent dealing with permits was away for a while as he was experiencing difficult times in his personal life. So No one else could give us the permit that was supposed to be posted to us by this particular agent. We kept calling, emailing and attending their offices but they said we must wait for his return. When we were being issued PCNs we called the building management agents and told them to do something to stop the PCNs at least, if they can do nothing about sending the permit. They said no need to worry and they'll sort it. As they were the ones who had a contract with the PPC we thought they would contact the PPC and ask them to stop issuing PCNs for our vehicle because of the permit issue.

    Basically, now we succeeded in obtaining the permit that was supposed to have been posted. It covers us for the period of the PCNs. We even have a copy of the service charge which shows we paid hundreds of pounds for that parking space. We also have a copy of the contract that was signed for that parking space. Although we handed this evidence the day before the hearing, the judge said he can't disallow it even though the Claimant demanded it should be inadmissible. The judge has therefore adjourned the hearing so that the Claimant can defend against this new evidence. The Claimant had nothing to say to defend against this evidence on the hearing day.

    The judge said he will award the claimant the £100 he is asking for because if I had provided this new evidence earlier then there may have been no need to come to court and the matter would have probably been resolved. I think this is a great cue for the Claimant to take a hike.

    I just wish there could have been a way for us not to pay the £100.

    Aha, I agree this is a cue for the PPC to take a hike and discontinue.

    Then you can - in a formal Letter before Claim - ask the agent to pay your loss of £100 and your costs for taking a day off and travel to attend that hearing (the agent who witheld the permit and caused this).

    Go on, LBC to them once the PPC discontinue. People NEED to go after those who contract with parking firms, where that landowner has caused them loss or detriment.

    Why should you be out of pocket by the agent withholding the permit (for whatever reason) yet failing to tell their contractor to cancel the PCNs, and letting their agent sue you for something that was outside your control, and comes full circle firmly back to the fault of...that AGENT who contracted the PPC and then failed you.

    Good evening everyone,

    If I may trouble you again with something ...

    1. I have just remembered that on my hearing day the judge looked at the contract between the parking company and building management which the PPC was claiming gives them the right to operate in my area. So the judge noted that the contract is dated but does not state the period. In the contract it just says "for a period not less than 12 months". How can I know the contract indeed lasted until 2018?

    2. I also have just noticed that they have redacted the schedule which says "number of sign erected".
    are they allowed to do that? if not, why did the judge not make a point about it? I know they didn't have many signs, I remember!

    I am going to win this case because of the permit and agreement that I have provided but I want to raise the above points to the judge so that he realises how dirty these mongrels are.

    I agree - raise those points if they continue.

    Or, LBC to the agent who withheld the permit unreasonably long and caused you loss, if the PPC discontinue.
