i think my previous post was misunderstood - having experienced several friends go through 'sackings', some of which were downright wrong, against employment law etc - the most i have seen anyone get was a year's salary.

what i realised at that time was that however right an employee may be (and wrong an employer is) they can get rid of anyone if they are prepared to pay ( i didn't mean the OP would get that much).

it also depends on how clued-up the employer/local HR are - a friend (plus colleagues on one occasion) has been sacked twice wrongly - he took it to appeal and won both times because of their incompetence in following their own disciplinary policy and employment law. but, they got their jobs back (or paid a few grand to leave) and just paid back for the time from which they were sacked.

would you still want to work there? can you be transferred?
  • Thats ok thank for popping back in.

I have new job cannot possibly think of going back I was a manager so now my name is marked I will never get promotion from here on in so there is no point returning.

You could take them to a tribunal (I am doing that with my ex employer at the mo), unfortunately there is no law to prevent you being a bad employer either. You could be offered something called judicial mediation which is what the employment tribunals are doing at the moment. You could also be offered an out of court settlement along with an agreement where you don't let anyone know other than immediate family what you have been given because if you do then it will be taken away from you.

If you are offered an out of court settlement you don't have to accept it but you can depending on the offer.

Good luck in the new job btw.

there's plenty of laws to stop people being bad employers, and it's illegal to sack someone without going through a fair and open process, it's called unfair dismissal. good luck richie, i'd strongly recommend getting some support from a union rep or citizens advice if it goes to tribunal, they're tricky things to negotiate at times.

Hope all goes well for you, don't let them get away with it!
