Rugbymum - I am always misreading things when I am stressed, text can be horrible to work with when you are having a bad day (well for me its also when I am having a good one!)

Ex-spendaholic - having read a few forums about Apex it seems they specialise in buying debt, possibly one of your creditors has sold you on

It seems they try a pretty hard sell to start! Either way, they will just need to get popped on to your DMP, and I assume when they write to you, you will be able to see what debt it is!

Hi Maz. Yes I just used the template letters. There really is nothing to it. I have another Halifax Cardcash claim to go in for £2400  but I'm waiting until they credit the other 2 accounts. Not sure why I have waited but I did. I'm now waiting on responses from Open and Direct and Cahoot who both had letter 2 as they refused to pay anything back. I'm waiting on GE Money x 2, Argos and Egg to come back with information on what charges I had. Oh and Studio had Letter 1 sent on Monday so I would expect to hear something from them in the next week. I reckon they will be next to settle.

How has your day been Angel Cake?

Thanks for asking Rugbymum, (sorry to hear about the other thread)!

Not a bad day, had a letter from MBNA to say there would not except the proposed amount for the DMP, they wanted another £50 plus on top of what was offered.

If I do not make this, they will default the account and pass over to DCA. Can anyone advise on this..... from ready previous posts I have seen comments like.......... Creditor X will not accept the DMP, I just wish they would defualt and pass to DCA. Does this mean the the DCA are likely to accept? Advise gratefully recd.

Had a call @ 8.30 last night (did not get to phone) when I called back 2 mins later, phone clicked and went dead. I googled the number and surprise surprise it was the lovely Mercers!

Now, I put my common sense head on, as they had told me on Monday a door step collector would call this week. If that is the case, why are they also ringing me? Hopefully these are scare tactics. (still keep looking out the window though)! Anyway have recorded day and time and will continue to do this and if it gets too much, will report them!

I have also sent a professional but very stern letter to BCard regarding their attitued and threatening behavior.

Apart from that, just plodding on, phone is quiet, just waiting for todays post.

Have good weekends all and enjoy the sun!!! Would be grateful for any thoughts on above
    Cheers xx

  • :) Hi

Feel a lot happier this morning after a break with friends last night. But be warned I may speak too soon as our mail hasnt arrived yet so moods may swing so get ready to duck! :rotfl:

Anyway already had a few calls from I can only assume credit cards but I have ignored them :) Knowing what I learnt yesterday about I have no obligation to answer them and they cant have me for not co-operating just cos I ignore the calls its good. But why oh why when I have told them in the past I no longer have a mobile number (which of course I do but who wants those calls when your out at the supermarket or in the loo at the local lol?) they continue to call my mobile and have the cheek to leave a message, which then costs me money to retrieve so I can delete it so my mobile doesnt keep flattening the battery to remind me I have a missed call  !

Ive even tried giving my mobile to my hubby or friend and they tell them they have no idea who 'Mrs E' is and please stop calling (they bought mobile from car boot sale etc etc etc). No use!

RE the default notice. After composing myself and reading it again today The letter states "I am attatching a default notice which you should read carefully. If we do not reach an agreement with you, we will record information about your account with one or more Licenced Credit Reference Agencies. This may make it difficult for you to obtain credit in future.'

It also says 'to ring them if I want to make a payment by debit card!'

So is this a warning / last chance to make a DMP arrangement or is it official?

I would like to call them and let them know I AM working on a DMP with National Debtline, but I am concerned to do this before I have found a new bank account to switch to. This debt relates to a credit card with Nationwide, where I currently bank and have savings in accounts with Nationwide also! Need to shift it all urgently before they can take it off me!

Do I call them again today and explain I am setting up a DMP, offer them a token payment and ask them to bear with me ? (they should already know this but its taken time as CCCS & PP have not been able to help me :o ), or is it too late is this an official default? to me it looks like a final warning / scare tactic.

    Thanks

Off to read post its just landed on letterbox!

Brace yourselves folks it may be a turbulent ride again! ;) :rotfl:

This may be my last smile for the day :D
  • :D No its ok folks I am still smiling!

Just 2 heavy envelopes in todays mail. Both from Natwest bank to say "Welcome to your new account" and can I sign and send the paperwork back for the saving account and take some ID into local branch for basic account" where they will check and approve and get my accounts opend!

Phew! Seem to be moving foward at last! :D

    Thanks

Ghosthunter as far as I know you have the chance to pay what they are asking and not getting a default. I would ring them and tell them that the DMP is being set up and offer them a token payment. They can't take what you don't have.

Angelcake, once debts are passed to DCAs interest usually stops. You pay them each month and you don't really hear from them unless you miss payments.

Nothing new at my end. Heading out for school uniforms later before the M&S 3 for 2 offer ends.

Happy Days Ghosthunter. Now is there any way you can get yourself into Nationwide today and get your savings out. Ask them for a bankers draft which you then can put in the new account? If you are looking for a savings account I highly recommend the Post Office Instant Saver. It pays 6% or thereabouts. You'd be best not having your money sitting anywhere there is debt.

You see the good days are coming. :T

    Hi :)

    Thanks for info.

I Just rang them up and explained situation. They said they were unable to accept token payment and would not agree to a DMP!

Asked why my circumstances had changed, so I said well if you had read your notes you will see why as I have been keeping you up to date for the past 3 months! Actually got an appology he 'failed to see that part' (couldnt blooming miss it I thought more like!!) :o

Still wont budge so I laid it on thick and said I cant pay what I dont have. Put on teaful voice and said I was trying to deal with my debts, not ignore them. Explained why CCCS & PP cant helpand said its all taking longer than I expected but now in talks with Nat Debt Line who sending me paperwork this week so they (NW) will get a copy of income /expentiture and a token payment as I want to get this started asap to avoid the default!

He said if I could pay them £145 in next few days (borrow it maybe from friends or family) I could avoid default altogether! I ignored this didnt answer.

He said something then about they wont accept a DMP so I said in my weepy voice well I cant do any more than pay £1 under my situation. I already have more going out than coming in with my priority debts alone, when they get my DMP they will see this!

Apparantly I had previously agreed to pay £2 so the £1 was unaceptable. He then said something about more like £5 and if I could show I was able to keep up minimum repayments for next 3 months (ie aprox £40 a month or more) and that I could increase my income then they may look at giving me my card back and cancelling the default!

I said well I simply cant even the £1 is more than I have, I have more going out alone on my priority debts alone than I hjave coming in. I cannot increase my income until at least November and by next month ny income will possibly decrease even worse due to price rises and benefit cuts and tax credits being reduced!

They simply wouldnt budge but I kept reminding myself these are scare tactics, hes being a bully I cant pay what I dont have etc etc etc.

He asked my for an alternative contact number so I said I dont have a mobile anymore cant even afford to top that up! So he asked for a works number and I said I dont work now and reminded him I was receiving Incapacity Benefit and stopped work back in August 07 as we had discussed a few moments ago!

He then said he sympathises with me and all he can do is put a note of our conversation on my account files. So I said they will get my DMP income and expenditure details hopefully by end of this week and first token payment of £1. Thanked him and hung up.

Will try and get into branch today, if not will pull out as much as I can via cash machine over next couple of days and go to Post Office for saving account Monday. Also look into alternative saving places Thanks for that advice. Will also do the same with my Barclays account in preparation for the other debt demons!

    Thanks :)
:T Hurry up better days! ;)
