More good news from me on the bank/credit card charges claims.
Halifax A/C 1: Claimed: £2650 Received: £2944
Halifax A/C 2: Claimed: £3051 Received: £3315
Halifax Visa: Claimed £650 Recieved £650
I'm not sure how it is all going to work. With the first account they said they would pay the money to bring the OD up to its limit then put the rest to any mortgage arrears. The 2nd letter said that they would bring the OD up to its limit then pay any remaining into the credit card arrears and any mortgage arrears in that order. The 3rd letter said they would put the money into the credit card.
I had some mortgage arrears but these have now been capitalised. The credit card has a balance of £5500 ish on it and is part of my DMP. Do you think they will pay it all to the credit card or will they class arrears as the difference between the dmp payment and contractual payment?
Anyway I just want to encourage any of you with charges on anything to get claiming.0 -
We have an account which is going to be passed onto a DCA in September, would now be the ideal time to try and claim back charges? Or can it be done once it's with the DCA?No longer using this account for new posts from 20130

I just want to ask about these charges many people on here talk about, can you claim these charges back when you are on a DMP?
What charges can you claim back exactly? the interest? the late payment fees? from when? from the time you opened the account or since you got in the brown stuff?
Sorry to appear a bit of a thicko, it sounds great that you and others have managed to claim back money I just wondered what exactly you can claim and when.
Had a letter from Lloyds today, their collection agency in Brighton who wanted me to call them IMMEDIATELY to inform them if I am going to have trouble making further payments for my loan, damn right I am, I'm on a DMP
Are creditors stupid or what? I sent the template from CCCS last month giving them all the information I need plus a token payment. I have had letters from my other creditors saying thanks, we accept your DMP arrangement blah blah blah.
So I ask should I be replying to every letter that comes to me such as this one and explain the same information over and over or shall I just let the DMP payments run their course? The creditors have all been informed by now so shall I just ignore these kind of letters? Lloyds haven't stated it has been passed to the DCA it seems just to be a standard letter from this place in Brighton.DMP support thread member 211 :cool:I'm only here to get some medals......honest!0 -
To cut a long story short on the charges.
Bank charges - there is a stay on claims at the minute. Banks are not paying out until after the court case. However they are paying out in the case of financial hardship. I never actually claimed financial hardship - they themselves decided this was the case and this is why they have paid out early. I'm not sure if it was because I'm on the DMP or not. It is worth putting a claim in. The best thing that can happen is that you will get a payment now and the worst thing is that you will be told to wait until after the court case.
Credit Card Charges - There is no stay on these. You can claim straight away.
Basically you can claim:
Unauthorised overdraft charges
Charges for failed transactions - DDs, SOs, cheques etc
Charges for paid transactions which take you over limit - DDs etc
Credit Cards - Overlimit fees, late payment fees, default fees etc
You can claim back for 6 years. Yes you can claim while on a DMP. I was very scared to do this a year ago when the DMP was new. I was panicing that they would cancel the DMP etc. However I don't fear creditors any more. Yes you can claim even when an account goes to a DCA. You just claim from the original creditor.
There is a whole forum on here devoted to claiming. If I can help anyone do give me a shout. For the 3 I've got so far all it has cost me is 2 x 2nd class stamps and 2 phone calls.0 -

Im a newbie and i would really like some help with my current debt please
Ive just joined the CCCS and they have set up a DMP to pay back my £33.5k worth of debt!
Im so scared as my main debt is a personal loan of £21k! I know im sooo stupid! my payments were £250 a month but CCCS are proposing £114 my mortgage is with them too so im scared of what thye'll do!
My other debts are
HSBC Overdraft - £841 CCCS Proposing £19.75
HSBC Overdraft - £597 CCCS Proposing £13.77
HSBC Credit Card £2058.00 CCCS Proposing £22.96
HSBC Overdraft £876.00 CCCS Proposing£20.21
HSBC Credit Card - £3454.00 CCCS Proposing £59.70
Bank of Scotland Credit Card - 1197.00 CCCS Proposing 22.96
Bank of scotland loan £20017.00 CCCS Proposing £114.81
Halifax Credit Card - £1550 CCCS Proposing 15.16

Am all at sea with this DMP thing.
Up until this month all my payments were bang up to date with the minimum payments, now this month I have not paid 4 things, 2 got paid in full minimum payment, not even a token payment was sent to the other 4 and they are past their due in date.
Problem I have is, as I have not still got another account sorted and wages etc will be going into my current account - loan, o/d and cc attached to that bank, I thought this month was still best to let them think all was well as the end of this month anything that went in would just get taken leaving me totally in the lurch. Anyway, the 4 not paid am confused with. Do I send them tomorrow first class DMP CCCS template letter with £2 token payment by postal order each, even though main bank not aware? Not likely to hear about a possible new account until about the 25th of this month, have applied to two places just in case one falls through. I get paid after this date and to late to let work know of change of details, has to be done by beginning of every month!
Am now in arrears effectively, so figure should send off them £2 payments? As August now nearly here, would mean sending yet further token payments in August, is this ok to do? Already had one creditor continually phoning but being ignored.
My dd's etc are all over the place. Not even sure what I will do if I do not get another account.
CCCS sent me forms end of May and still been burying my head. I guess it's ok to send them off now? But that is the other thing, if I send them their forms with bank details etc are they likely to alert my bank to a problem before I do and they take their money as soon as it hits my account? I won't have a penny to live on if this happens let alone meet priorty bills.

Kirsty, firstly you are not stupid. Secondly, it is natural to be scared. I promise you though that it will all work out. You are probably thinking that the DMP seems too good to be true but it will work out. Things will get easier. Its just really a waiting game at the minute. You ask for experiences of your creditors. I have Halifax Credit Card on my DMP. I owe them about £5500 and they are getting £21 a month from the DMP payment. I also have Next. I owe about £500 and they are currently getting £5.71. So to compare my figures to yours I think they should be happy enough. Creditors generally do take heed of the CCCS.
My mortgage is with Halifax who are on my DMP for the credit card - this has had no impact. They are separate agreements.
I know I keep harping on about bank and credit card charges but do you have any you could claim back to put towards the debt?
Atmywiitsend, calm down. Do you have the money to pay the contractual payments to the other 4 creditors? If not just send them token payments. With regard to your credit card you will probably find that this is a totally separate area to the bank than your bank account.
With your salary if you are concerned about it, I would arrange to be at the bank on the day it goes in. Lift what you can from the cash machine and then go into the counter and withdraw the rest.
Don't worry you are on your way to sorting things out. It may all look like a nightmare at the minute but stick with it and you'll be breathing a sigh of relief in the very near future.0 -

Ex spendaholic, - thanks for your above post ref claiming back credit card charges whilst on dmp, im doing my own dmp and this is the next thing on my list to do, ive got them on a plan for next 3-4 or another 8 months, so i think now payments being made on time for the past 4 months - want to tackle the charges refund on credit cards and store cards debenhams and evan, whilst some of the amount are under 100.00 i think the refunds would at least reduce what is currently owed.
So will let you know how i get on - thanks for your inspiration though.
kirsty 64 - welcome to our gang, im doing my own dmp, have halifax and bank of scotland , i got 12 months no charges or interest from bank of scotland, but halifax since terms changed have offered me reduced interest at 12.64 per annum no charges though for 12 months, so not too bad,
atmywitsend, welcome to you too, i agree with ex spendaholic, try and send the token payment at least something has gone to them until you can sort out all the rest of your payments perhaps you could do what we call a statement of affairs, so that you can list your outgoings so people can help you with what your current regular payments are and see if we can suggest ways of cancelling or improving what you actually pay out, ie food, utility bills etc etc,

That's what I did the month before starting the DMP - sent full minimum to the bank I have my main account with (so they'd think everything was fine) and then sent token payments to everyone else saying - can't pay it all.at_my_wittsend wrote: »CCCS sent me forms end of May and still been burying my head. I took ages to send of my forms too - in fact they were emailing me asking me if I was ok (I took that long). I also sent them a letter saying please can you not notify my main bank until my wages have cleared into my new account (to check my employer had set things up). They rang me to say they had to either put the DMP on hold (but enter details ready) or go ahead with it all. By that time I'd been paid into my new account so was able to tell them to go ahead.
They wrote to everyone with proposed payments within a few days of me sending the signed agreement etc (as my main bank were the first to ring).
If you are really worried - ring them or email them
They are so nice and helpful - even when you are crying hysterically down the phone at them(been there done that

Starting a DIY DMP.
Lloyds have written accepting the proposed payment. No idea if interest will stop, the letter is not clear.
HFC have written asking for proof of income, proof or mortgage and proof of education fees (Trips and visits - not Eton or Harrow).
Are they entitled to this? what do I tell them? I think Rayday has experience of this one.0
