  • Have just been accepted onto DMP with cccs...yay:j feel like a huge weight has just gone off on its holidays.

So now the fun begins...when all our creditors realise there aint no money in the kitty this month to pay them!
I have already transferred my regular payments into new account, just need to transfer mortgage etc across. Tempted to wait until 1st Oct bills been paid, by then will just about be ready to switch permanently to new account.
I don't know how long it takes for certain payments to move across!!!

Could I possibly have a DMPer number now seeing as I am now one of the masses?

I have had it confirmed that the bank are likely to keep charging me interest/charges until they default me...I like any others will await the outcome of the court case, then hopefully claim it all back :D
Thanks to you all today for answering my many queries.
    xx

    Hi,

The bank will continue to add interest and charges to your current account for as long as they can. That is why you need to basically abandon this account and open a new basic bank account somewhere else for your money to be paid into and for your DMP payments to come out of. Once Halifax relise what is going on, they will default the account and all interest and charges will stop. You will them need to reclaim the charges back once the High Court ruling for bank charges is finalised. LLoyds TSB did this to me and kept adding the charges month after month for nearly 5 month, racking up an extra £800 in charges. I know that these are unlawful and will simply claim them back when the High Court case is over, thus reducing the debt I owe them.

Says it so much better then I have been trying to say it, I suck at explaining things :rotfl: 2 months now I have watched my HSBC loan payment attempt to be collected from my HSBC current account that is over the overdraft limit due to their own charges, then bounced and more charges added. Its frustrating as hell but you just have to wait for them to default the account. All my money safely pops into my Basic bank account away from HSBC and they get their monthly portion via CCCS.

I would always recommend opening a new basic account so you remain in control of what YOUR money goes towards and prevents your Creditor bank dipping in when they want.

Apologies ... just wanted to have a rant about the Nationwide!

The Nationwide originally accepted my CCCS DMP for three months, freezing interest and charges. Then they refused to accept it any longer so started charging interest and charges - and constantly chased for the overdue payments. (I refused to go through the security questions when they called. I complained and got the calls stopped.) The account is now going to default - to be honest, I shall be relieved when it does.

My rant is about their latest automatically-generated letter, received today. Its content has really made me mad  as it's incredibly intimidating and threatening. For example:
    • "If you don't make an immediate payment to clear the amount due, we will instruct KPR Debt Collection to recover the outstanding balance. This could include solicitors being instructed to take legal action, which may lead to a CCJ being obtained."
    • "Other action may include a visit to your home to discuss your financial circumstances and payment proposals."
Of course, the crucial words here are could and may ... but so easy to miss when reading the letter as you bypass these less harsh tones.

A sentence in the last paragraph says, "We understand that some people experience unforeseen financial difficulties and it is not our desire to make their circumstances more difficult". Standard letters make me so mad as I've lost count how many times both I and the CCCS have told them about my DMP.

They'll be receiving yet another copy of my very own standard letter reminding them of the DMP!

    Rant over ...

Thought I'd take the opportunity to thank everyone again here for the great advice and support. Had I received this letter earlier in the year, I'd have been in a right old state now!

  • Welcome to TotallyBrassic and any other new people. TB, put your claim in for charges once the DMP is up and running and they have accepted it. Best to get the claim in the queue. If you can prove financial hardship then you may get a refund sooner. Also if you have credit card, loan, store card charges etc these aren't on hold so you can get them back.

To those of you looking for numbers, thats a wee job that Rayday does when she is around. I'm sure she'll sort it when she is next on.

Nothing new here. I had a letter this morning from Argos Card. I am claiming back charges from them. They have offered me £80 of my £323 plus interest claim. I have wrote back saying that I want the lot.

Also I sent off 2 letters - 1 to Studio and 1 to Next. I have offered them both a third of the debt owing as full and final settlement. I doubt they'll accept but I did it anyway.
