    Hi All It has ben a while since I was last on here and as you may have guessed I am back as I would like some advice LOL

    I have just got a letter from Lloyds TSB 'soliitors' it is on grey paper and look computer generated the names are Sechiari Clark & Mitchell am I right in saying this is an inhouse letter as a scare tactic? I appreciate your time guys, thanks.

    It is just another department within Lloyds, I had the same the old "grey" letter. Have they accepted payment or not? If they haven't just send them copies of what they have been offered etc and stick to your guns. They usually give in and accept just after "grey" letters its like there last line of defence.
  • HI all, sorry not posted for a while, but I will explain why I have been busy....
    Firstly Rayday well done on your school news.....I would very much think (100% sure) that as a contract is being prepared it is being paid, hope so! Keep us updated....

    I posted a few weeks back about rental check as I was looking for a cheaper property and was worried abouth the 'credit checks'.
    Well good news! I have spend the last few weeks looking for something and have found a lovely house which is an amazing £500 cheaper per month and the council tax is £40 cheaper a month. :j More good news, the credit checks came back fine! Think they were looking for CCJ or BRs.:j :j

    Now the tricky bit.....As this is my 3rd month on Payplan, do I tell them about my savings now, or wait for my review and but the savings away for a 'rainy day'? :confused: (or Christmas) Advice greaty received.....

    Now the bad news....I have come home to a nasty letter from HSBC.
    They have been ringing constantly for the last few weeks and we have told them we are with PP etc...they know this but will not accept the DMP as the payments are too low for them.
    The letter today is a FINAL DEMAND. We have 14 days to pay in FULL or let them have a satisfactory proporsal for repayment by instalments or otherwise.
    If no ACTION will be taken throught DEBT COLLECTORS or SOLICITORS and my may be taken to COURT.:eek:

    Lots of Captial letters in bold on the lettes!

    Has anyone else had one of these, do they mean business or is this a last ditched attempt to get us to pay more before passing to a DCA? If so, would the DCA be more accommodating? Hubby wants to call them tomorrow, but not so sure??

    Well firstly well done and me personally this side of Christmas would keep the payments the same unless you really want a couple of months earlier debt free that is all you will achieve telling them now.

    And as your letter said it MAY result in court etc, I am pretty sure its just what it is a frightening letter. The first bit says debt collectors, ie debt collection agency - those lovely people who WILL accept lower payments!

    No one can ever say for sure that you won't end up in court but 99 times out of 100 it is just tightening those thumb screws. But I appreciate those letters are not nice to recieve. So fingers crossed its routine but let payplan know you have your "final demand".

    If you still feel nervous about that letter you could see if you have enough to write a formal complaint letter about harrassement etc http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf this is the link about how companies should behave when chasing money. Don't forget if you do go about the formal complaint route to make sure you put your demands in ie, accepted payment plan, refunded interest and charges, no more calls etc etc

    Thanks for the advice on the letter and the link you sent, I think I need to start getting tougher with these people, writing letters and claiming back!
