MBNA (Abbey) for me have been a little irritating. They get RMA and themselves to phone every day for the last 2 weeks (Just made my 1st payment to PP). They demand to know why I can't make payments, when obv they know I'm on a DMP.
Just a wee bit concerned that they're not going to like my payment offerings...DMP mutual support thread No: 2430 -
After sorting out my DMP with CCCS it kicks in on 1st Oct, I contacted my 9 creditors with token payments at the beginning of Sep.
So far I have only heard from 2 asking why my payment hasn't been made, I wrote again giving them CCCS number etc, so far nothing back.
This morning from Capital One I received a "Notice of Default Served under section 87 (1) of the Consumer Credit Act 1974" Sayiing that I had broken my agrement with them because I have entered into a long term payment plan for a comprimise about how much I will pay them (or something like that)
I assume this is about the DMP, this is the first time I have received anything like this, should I do anything (let CCCS know etc) do I need to be worried, should I write back to capital one? anything else?
Any help greatfully received

Hi tranceaddict, I am on a DMP with Payplan and one of my creditors are Capital one. I also had a letter like this from them, it basically means they have accepted your DMP and as you have not kept up your orignal terms of the agreement, you have defaulted.
Do not worry about this, it is actually a good thing they have defualted so early, and also they seem to have accepted your DMP!
There is nothing more annoying them being on a DMP for several years then being defaulted. A Default stays on your Credit File for 6 years from date of issue, so the earlier you get them, the better.
I would just send a copy of this to CCCS so they have the details on file.

hello, you will receive default notices from probably all of your creditors. they don't really mean much so don't stress over it! - you can forward them on to cccs so that they can note on your file.
as for phone calls about your dmp - just explain that your dmp doesn't start until x date, and you can't make a payment at this time.0 -

know how you feel, I have made 3 payments to payplan and they(creditors, 2 of them being banks owed just over 20,000) have just acknowledged my plan offer, and have accepeted it today!
Oh and the endless phone calls/letters will stop eventually.........I were getting calls 7.30 in the morning from yorkshire bank on a sunday.......
just keep on plugging, they will bend eventually!.......oh and I wouldnt worry too much how much you are offering them......at the end of the day you cant give them what you aint got.

Jes F1 -Best wishes on your DMP. I too had a lot of trouble with Nationwide building Society and their in house collection team KPR. I have never came across a crowd of more unhelpful people in my life. On their website it shows these young,positive,focussed young staff saying what satisfaction it is to help people with their money problems and how rewarding. Yeah rewarding in thier own bonuses. In all my dealingswith them on the phone they just didn,t care about my problems and ignored my DMP. I cringe ever time their silly ads come on tv.They are a nightmare.0

...we're just starting to get the phonecalls, all quite amicable really but I am worried about who might not agree to the DMP or might not stop the interest. We have:

bcard been okay accepted the dmp and stopped interest and charges,
the other ones ive got are virgin and mbna, which are both mbna controlled, and eventually accepted the dmp, but im battling for copies of my cca now and they are playing the fools im afraid, not sent me correct and legible cca copies. So im on a bit of a battle, only because im on the stage of ensureing if they have or do not hold a correct and valid cca, if they dont then they cant enforce court action, not that im not intending to pay my debts i am, but once im back at work, i want to offer a full and final settlement to all just so i get rid of the debts as a faster means.
RMA and NCO Europe could be their chasers for constant telephone calls until your dmp is accepted, once accepted i dont have to pay interest or charges and surprising not had a default yet from them. The calls have stopped only after i sent a very direct harrasment letter as they were calling my work no and i wasnt even there, and i changed my mobile for the constant text to call them .
im now asking for my data info from mbna, and they want copies of my driving licence or passport and ive had help off consumeractiongroup guys and am sending a strong letter advising them this is not a legal request and thus not sending nothing, and they can forward the data to any local bank branch and i will collect my data and only show my id on collection not for them to retain a copy.

but a warning to all, i would still suggest you get a copy of your credit card agreement for your own records it is your legal right, and continue with your payments still of course. At least you can still check the agreement to ensure it is correct and legal for your own peace of mind.

it looks like you have come quite a way down the route.
as i do my own dmp like some others here, could i clarify please, the debts you are paying are now without any charges and interest and thus the plan with cccs says this to you? Also the date you have been given is for what you have to pay every month until that date?
So in theory if you came say into some money could you still be able to offer any full and final settlements as they could be lower? or are you now stuck into this arrangement with cccs?

Got first response to DMP offer (start dmp 1st Oct with CCCS) - Barclaycard said "thanks but no thanks" but I didnt expect any different. A shame really seeing as how they charge me £22.50 everytime they send a letter (weekly!!!!!) - I WILL be claiming all that back at some point!
Oh well, 1 response down, 14 to go (well 10 if you consider the four different depts I owe money to from HSBC).MSE-ing since 20070
