I have written this letter to send to the Halifax

Does anyone know of anything else i could add?/ change?

We are currently paying reduced monthly payments for these accounts through the CCCS. This DMP arrangement began in December 2006.

In February 2008 you began adding interest and charges onto the accounts again, even though we are still paying through the CCCS and on a DMP. The interest you are adding is exploiting our financial position, increasing our debts, and in effect wiping out all previous payments made on the DMP. This is not helping us to reduce our debt and is unfair to other creditors when they have still frozen the interest on our accounts. We are doing all we can to reduce our debt but we are not able to do this if you insist on adding charges and interest.

In my opinion the Halifax has been hugely responsible for our financial situation, you have given us poor advice, shown irresponsible lending. The mis-selling of payment protection and the addition of unfair charges has spiraled us into huge debt.

I feel that you could help now by stopping all interest and charges on our accounts in order for us to carry on reducing our debts, which is beneficial to all parties.

If you do not do this we shall take our complaint to the financial ombudsman

We got a deal with Chelsea Building Society at 6.34% fixed only been in it two months I think it will go up to about 7.24% but if we keep our payments going for teh two year then they will remortgage again ignoring our credit history and we will get the rate anyone does with a good rating if that makes sense.

We had been on a DMP for two years.

Thanks Rayday this is encouraging to know,

i was wondering if we apply to our bank for a mortgage they might be able to help?

If they have refunded it, this is probably no longer an issue to quote. If not, CLAIM!

I feel that you could help now by stopping all interest and charges on our accounts as you had initially agreed in order for us to carry on reducing our debts, which is beneficial to all parties.

Hi Anychance. I love the directness of your letter to the Halifax and, I find it hard to argue with any points therein. However, the older I get ( Mid fifties) the more I like to sleep on sending such letters, emails, texts, carrier pigeons etc. Its very annoying when creditors do this, but, do it they do, and are within their legal right to do so. Much of their approach is "trying it on" and this just happens to be your turn, flagged up on a timer perhaps in their computor system. I've experienced this a few times and usually do two things: a) Request that CCCS contact them requesting a continuation of my DMP and b) I phone them and lay out my stall, which, usually hasn't changed since my last CCCS review. I doubt that the Halifax will be deterred by an 'attacking' form of letter, any more than a 'pleading' one. As I said, its just your turn and perhaps a more subtle approach might suffice. Also, get right to the heart of their 'financial hardship's department' and try to get through to a supervisor. I've found that they seem to have more clout.
  • Hi All

Just thought I'd update you, got a telephone appointment with Payplan tomorrow. Was so close in cancelling my Direct debts and sending out the token payments. However as Andy mentioned a couple of pages ago, my Northern Rock together mortgage will not need separating. Now I need to think how me and my family are going to survive this month with only less then £200. At least I'm doing the right thing.

    LOL thanks cloudnine,:)

I didnt really intend it to be aggressive just stating what i think are the facts. I realise this may not change anything but if everyone complained to the FOS re reinstatement of the interest then maybe someone will listen. Then once you enter a DMP they have to stop charges etc.

Other wise what would be the point, we may as well go onto IVA or BR

I pay 221.00 pm they slap on 300.00 pm if this causes me to go bankrupt what effect does that have on the other creditors? Everyone loses out then

So all in all i may as well send a letter - theres nothing to lose :D

Thanks for the advice on calling them i will get OH to give them a bell and try again, he has contacted them before they told him it would take 3 months before they pass it on to DCA but i would like to see if i can get them to take off the amount they have added

    Hello there Pinksparkle

Glad you are not worried about them calling you, i was horrified until we started the DMP then all went quiet. If anyone hasssles you, just ask you to send anything they have to say by post.

I have been on my DMP since December 2006 it has been on the whole fairly quiet, a few hiccups and the odd phone call but this has died down now.

And it feels good to know you are trying to pay off as much as you can

    Good luck x

Went and bought my £1.00 postal orders this morning, was shocked to find they each cost an extra 46p, so I only bought 2nd class stamps to save a little bit.
