  • rugbymum, sorry to hear about your very unpleasant phone call. It sounds like a lot of hot air from this woman to try and frighten you. If they had a CCJ against you, you would know about it. They have to send you a letter before action first, before the Court papers. Also, I doubt anyone is going to call on you, this is another scare tactic. Keep strong and stick to your guns with these people.

    longforthesun, Cap One is one of our creditors and the first to accept our DMP. I can't really help however, but it does sound as it they have accepted your monthly payments.

    Don't be too upset....it's a horrible situation....

    I was in a similar position re student loans a couple of months ago (like you have to defer as never having earned enough to pay back), but they passed mine to NCO who were a nightmare: lied about the amount I HAD to pay back, lied about letters they had sent out, lied about stuff I had sent- claimed they had received, then had, then hadn't...threatented me with doorstep assessors and didn't pass my deferral on to student loans for 3 months (and still haven't!) as well as getting the amount I was in arrears wrong by 100s...

    What I did was write a complaint letter to student loans getting them to look into it, which for me actually worked (they guarantee you a response in 10 days). Also send them the harrassment letter from here and IN WRITING recorded delivery ask them to send you copies of these court papers (and send a copy of everything to student loans). I have a feeling that student loans have been given a big talking to lately as they are far more helpful and pleasant than they have ever been...!

    Also it's worth calling them to ask for a new deferral form and get that into them RECORDED DELIVERY- they're very good at losing 'not receiving' them! (I am assuming you're on the 'old' type of loan like me where you have to defer yearly?) They emailed me one the same day. If you want to save the cash/hassle of the call, PM me..I saved mine and can email it to you as an attachment.

    Hi rugbymum - if you want to check whether you have any CCJ's then you can do your credit report. You can do this online (for a fee usually) or by sending a £2 cheque and a completed form to Experian or to the other one :confused: can't remember the name sorry.

    If you haven't moved house recently (where any court forms may have been sent to an old address) then I doubt very much that you would have a CCJ without actually knowing about it.

    Don't believe everything the debt collectors tell you - some of them just want to scare you into giving them more money ;)


    GH - I think you give a bit too much detail in your letter. You could just say that you are on IB and no longer have enough savings or income to carry on paying minimum payments. I would just say that your OH contributes £300 whatever it was - to the household bills and not say that he is working or that it's tax credits or that he's self employed. If you mention he works - they might just want to know all his income and it will complicate things for you.

    Keep it simple. Tell them enough - that you haven't got money and are on benefits - but not so much that they start harrassing you ;)

    longforthesun - it does sound like they might have accepted - "long payment plan". Sometimes they have to default you to stop interest (think it depends on the bank's inhouse procedures) so hopefully they will stop interest soon too ;)

    Rugbymum - I have always been lucky with Student Loan company, I always forget to defer payments each year but have always had someone call me to remind me to sort it out. Have you tried ringing the Student Loan Company themselves and asking what information they have? You never know, you might get some good advice from them.

    My good news for the week is that I got the job I went for this morning, it's not a huge amount of money but after being at home for nearly six years while the kids were tiny it doesn't matter to me anymore, the main thing is I feel I will be on the land of the living again (actually having an adult conversation) and my husband won't feel all the pressure of bringing in a wage. It's jobshare for 18 hours a week so I can still be a mum the other half of the day!

    Keep plodding on everyone, it might not feel great but each day is a day closer to being in control of your life again. Even though some of my creditors are being total pigs I now hold my head high because I know I'm paying things off and giving my family the life they deserve.

    I think so. I have a loan from Natwest and even though I cancelled my direct debit whenever money went into the account they took it out for the loan repayment as a standing order. I did call them as they did it randomly without warning me in advance but they said it was in the small print. And when I checked, indeed it was. Grrr!:mad:

    Thank you, thank you, thank you. You are all wonderful and your responses have been wonderful too. I've been busy.
    Firstly I called CCCS. Then I called the evil company back to get the CCJ info, they didn't have it. I called Student Loans They gave me the information and It turns out that the CCJ is from 2001. When I was moving between London and Suffolk. Never caught up with post, never remembered to defer loan payments either! So I WAS unaware that i had the CCJ.
    Anyway CCCS have had to add them on. I was due for a review today and my payments have gone down to £107, (were £378) I was a bit worried, but the guy was pretty cool and confident that everyone would accept change in circumstances.

    No, it is a Standing Order (SO). Under their terms & conditions you cannot cancel one of their SO for their own products.

    When you use internet banking to try to cancel a SO for a HSBC product it declines and you have to call the centre. The centre will not cancel it without lending branch authorization (I use to work in Audit & control and you would give someone negative feedback for cancelling a HSBC product SO!)

    In a nutshell, you have no control over a HSBC standing order.
