Does anybody know whether I can claim back £35 I was charged for letters telling me that my mortgage account was in arrears from the Halifax?

Yes in theory::T as it's likely to be a computer-generated letter.
The best thing to do is to go to the top of this page and you'll see "step by step guides" - click on "reclaim bank charges" and all the info inc this is there. good luck!
The law behind this
The core argument is that banks should only impose charges which are in proportion to their costs. This is because under the Unfair Terms in Consumer Contract Regulations the charge should not exceed the cost to the provider.
Yet go beyond your overdraft limit or have a cheque or direct debit payment bounce and the banks charge up to £39 a time – even if you’re only £1 over the limit. Yet all it has to do is send a computer-generated automatic letter with a franked stamp. A report by a Professor of Banking estimated this costed only between £2.50 and £4.50. And this was being generous.
All in all, this means, I any many others believe, bank charges are unlawful, or so as the banks had no right to grab your cash, but still did it, you’re entitled to get it back.
The banks’ primary argument has been that ‘unfair contract’ terms don’t apply to bank charges, but the Office of Fair Trading (OFT) disagreed so started the High Court test case to find out. Yet that was blown out of the water by the judge, who in in Apr 08 decided that bank charges are governmed by these rules. A great step forward for reclaimers.0 -
hi can anyone advise me as i dont have a clue about all this reclaiming stuff. I bought something online and i had money in the account. they didn't take the money until almost a week later when there was no money but my wages wee due to go in. Then the next month i was charged for them taking the money and causing me to go overdrawn. £25 & £15 i dont know where they get their charges from. Also i have just incurred a charge of £35 for an instore card payment. Can anyone advise me.... My son fell into arrears due to ill health with his comet account. I took over full control of his finances and was paying GE Money faithfully every month. After a period of time I noticed the balance was not coming down as quick as I thought it should and when I made enquiries they told me that his due payment date was the 7th of the month and I was paying around the 19th of the month. They were well aware that my son was ill and this is why I took control of the payments and yet they failed to advise me there was a problem.
I asked why there was no monthly statements and they said because with this type of account they don’t issue statements. All in all they have took around £300.00 in late payments which could have been avoided if only they had advised me. Can you please advise me as to whether he can claim these charges back.. Hi there, this is the first time I’m jointing and posting on this Forum. Apparently it seems to be fantastic. I hope to it could help us quite a lot.
Well, I’m really surprise that I have discovered only yesterday that I have been defaulted by Barclays Bank PLC (Woolwich) on 16/10/2007 of amount of £347.00. I had a personal account and credit card with them from 2001 until 2005. However one day I went to withdraw some money and they said that I could not do it, because the Bank had lost of my information/records, even my signature to compare. Therefore I decided to close down my account on that exactly moment and I did. I had a Loan with them and paid everything straightaway. Nevertheless, I have only received a letter from Barclaycard dated on 07/09/2005 saying that my credit card account has been closed. I have never kept anything about my personal account with Barclays after this day and I don’t even know if I have ever received any letter from them anyway.
I went to the same Branch today at 10:00am and they said to me that the head office will contact in 24hs, however they didn’t so far.
I’m really confused, because I do not owe them any money, loan or whatsoever as I had to pay everything before close down my accounts.
I will be very grateful if you could help me with any advice relating to it.

Hi there,
I just registered and I have a question. My building society account went into arrears (one month) in 2001. Since then they added £40.00 per month in charges without notifying us. When we finally found this out it amounted to over £3000.00 and we added it to the end of our mortgage and cleared the arrears. Needless to say if we had been notified of the situation earlier we would have cleared it up. Do you think we have a case for reclaiming these charges?0 -

Any HSBC customers that hold an overdraft facility can you advise if the NOTIFIED FEES/CHARGES that they charge if you go over your overdraft can be claimed back because some of my fees are £150 and then the interest debited seperatley which I know I am not entitled to reclaim.
Any help is much apreciated.

Absolutely ... go for it. You will be entitled to all late payment charges and the good news is store cards and credit cards and not part of the OFT case so you should be able to claim straightaway. Just follow the step by step reclaiming guide on the homepage.

I paid in my wages cheque and wrote 2 cheques against it, one for £15 and one for £35. My personal cheques were presented before my wages cheque had cleared and my bank charged me £38 for each cheque, although my wages cheque cleared the next day. I asked the manager and all I got was whitewash. Would I be able to claim some or all of these charges back?0

Hi sorry if this is a silly question, but I was wondering if I can claim back on OD arrangement fee? Does this come under irregular fee (so can be claimed) or service fee (can't be claimed back)?
I have had a current account with them for about 4 or 5 years and right from the begining I have had the same OD set up. Then I checked my account this morning and saw they had taken £25 for "OD arrangement fee". They claim they sent me a letter on the 8th Oct stating that they would be reviewing my OD, but I never received that letter.
Is there anything I can do or have I just lost the money?0
