Hi Summer, this is my first post here and I will be starting a topic as my case is slightly different to what I have read so far, well done to you though, and thank you for the warning on the 30 pages, I will get this printed off in triplicate asap.

On pensions I have just been reading up on that, and it will depend if the pension is "approved" or not, this has to do with HM Customs and Excise from what I gather, but here is one site where I read some bits and bobs on.

    http://www.debtangels.co.uk/common/faqs-bankruptcy.htm

Hope the link works, and thank you to my very good friend for sending me over here, I have now been reading here for about 8 or more hours, but it is all helping me right now, as sleeping is a thing of the past!

Thanks for that link, helpful. I think I might be ok, not paid into them for a long time, but I will check with the Debt Specialist I am seeing on Tuesday.

I know what you mean about not sleeping..lol...since my LBM about 3 weeks ago, I live and breathe BR and reading threads! Yes, 30 pages......thats my relaxing Sunday now out of the window.:D

I am still sitting here trying to fathom how I start my post on here, gutless I am not normally, but I feel a bit let down all round so the sooner I post it the quicker I may get some useful information from someone, and I have to say everyone here seems very nice and friendly. and look at the time and I am still up! What is an LBM..

Lightbulb moment. Or in my case, it was like the Blackpool Illuminations.:rotfl:

It took me a while to do my first post but it really helped. Firstly, because you get great support on here and secondly, it helps me having a diary to put down my thoughts and things I need to do.

Ok ta, you are helping me honest. Its this time of night my head starts working over-time with it all. This form is freaking me out, I had no idea it was 30 pages long! It mentions pensions, I have a frozen 14 year one with NatWest, and a couple of frozen 2 year ones, God, I hope I can find all the paperwork! Do I lose them as well?

I assume under secured creditors, that means my mortgage?

Why didn't I look at this form sooner, the meeting is Tuesday! :o
    Hi Summer,
Most company pension schemes do not need to be included.Your Nasty West Pension will almost certainly be a Final Salary Scheme and will be safe,Not sure about the others although I would think if they are a Group Money Purchase or Contracted out Scheme they would alsobe safe but best to double check with CAB or one of the other debt charities.
Secured Creditors as you quite rightly state are your mortgage lenders(who have the first charge) but could also could be any lender who has a second charge on the property.
As regards your I&E if you have no income you pay nothing. If the OR thought you could not afford to live even without your debts he would not make you BR(sounds daft I know)someone with less alcohol in their blood will come along I'm sure and clarify, but I think It's something to do wioth protecting you from going BR again.

Thank you. I worked at a Solicitors for two years and paid into one, have not touched it since, and then an Accountants for a year and the same thing. Pensions have always confused me. :D

No probs Summer the good thing is the biggest part of your pension is in Final Salary scheme. You need to get further detaill of the other 2 they could be at risk. But hey a pittance really. You take care .Any probs let me know.

It is LONG and I did not know how to word it all, but I have now. Pensions were one of my worries as well, and if it is a final salary or done over the past 3 years does that mean they wont touch it, it is with the NHS Deztitute? As if they are gonna take it I read to stop paying into it? As I say so much to read, and then Summer brightens my weekend with 30 pages of this form, bliss it is not!

    Morn summer

I did 4 copies of my SOA by hand:eek: the first one rough, then when i was happy with it i copied it to the 3 for court. My thinking was i would get the rough copy for myself, pretty clever eh. Yes until they gave me another copy back, stamped in court :D .

The I&E is what the OR sends so it is not in with your SOA.

Just list all your outgoings. Put the total, then put this total as your OH's contribution Where it asks for yours just put nil.

I had a company pension(from about 26yrs ago) which when i left that company i never paid any more money into. The OR said they don't normally touch pensions but i suppose it would depend on the type.

Have a nice day filling all those foms in:D D
