    hi,

my other half's driving license photocard expired in sep 09 but we have only just realised! Obviously we will renew straight away now but I am really concerned about him getting fined £1000. We really cant afford this as he is currently looking for work and I am the only one working until he finds something and we are already struggling to pay bills. Does anyone know if they automatically fine you or not? Really worried so any help would be much appreciated.

    thanks

Do they not only fine you if they can prove you have been driving?

Who is to say that he hasn't driven since September 09. ;)

I've just realised I've done the same thing, received it last year, for some reason got it all together, new picture and everything but for some mad reason I didn't post it.

Are they going to send me to prison or worse, rob me of £1000? :D

    Seriously what's likely to happen?

    Why?

You don't have to have a driving licence. So how can you be fined for not renewing it?

You do need one to drive of course, but how will anyone know you have been driving without a licence unless you tell someone or you are stopped by the police whilst driving and asked to produce it.

My wife has had a provisional licence since 1966 and it is still a paper one, in her maiden name and she has been married over 40 years, with the address she lived at in 1966 and she has moved 4 times.

I can't see her getting fined or imprisoned.

Of course in her first lesson she crashed the car and has never driven since.

This will hopefully allay some fears for those who have just realised that their photo has expired on their photocard driving licence and are therefore worried about a possible £1000 fine.

I was in this situation a couple of months back. I did not renew my photo on my photocard licence (due to moving about, absent mindedness and mistakingly thinking that when I moved and had my address changed that it that the 10 yr renewal count down had been reset). My photo had expired 16 months before I realised I had to get it sorted. I went straight online googled 'What happens if my photo has expired on my photocard licence'.........and promptly started freaking out that I was going to get a £1000 fine after reading the sensationalist news articles regarding the topic.

So I sent off my new form, plus £20 cheque and new photo......4 days later ,my new shiney photcard licence arrived. No fine.

As I understand it - if at any time during that 16 months I had been stopped by the police and they saw my photocard had been expired then they could issue a 7 day notice for me to produce a valid licence at any police station - with it usually taking more than 7 days to sort a new photocard it would mean I would have failed to do so and I would then receive a summons to appear before a court, which after being tried for some obscure law and found guilty then (and only then) could I have been given a hefty fine.

    Hope this helps.

My photo runs out next month so I will send a new one (although I haven't received a reminder yet). But I have a question about my paper licence: I have some speeding points that I gained about 9 years ago - will they send me a new paper licence when they send the new photocard licence or do I need to apply separately for a new paper licence?

    Thanks

When you renew your photo you will need to send both parts of your licence in anyway. Will they remove the points? My guess is probably not unless you ask them to.

The cost of renewing the photo and of removing points is both £20.

Whether you have to pay for each or not I do not know. I'd try asking for both at once if the option is there on the photo renewal form. If not, do a covering letter.

I had 3 expired points on my old licence and they weren't on the new one after I renewed the photo.

You're supposed to send in the old paper (counterpart) licence along with the old photocard - the new paper licence that gets issued won't feature any old, expired points (you don't need to specially ask for this to be done, it just happens like that anyway).
