A store simply cannot ban you for being overcharged or for noticing that you have otherwise there would be no price integrity anywhere as all shops would just ban the people that noticed thay had been robbed, how about Tesco take it one step further and ban all Trading Standards officers that would be another good way to ensure they can continue to break the law.
They can ban you for a multitude of reasons they can ban you for no reason but they CANNOT ban you for being a victim of crime especially one that they have committed and that the ban would enable the to commit in the future, that is as simple as I can put it I'm afraid. As for the policy being abused!
The ONLY way the policy can be abused is if Tesco allow it to be abused by not taking heed of and acting on the incidences of refund and replace, If Tesco amend any pricing error on being notified by a member of the public then that member of the public would not have an opportunity to obtain refund and replace again, in practice this does not happen because it is more commercially astute to allow the vast majority of its customers to be overcharged than to correct the error, what you have here is a situation where a store wishes to continue breaking the law and in order to do so has eliminated one of the finger pointers ability to highlight the sharp practice taking place and therefore continue to pillage the vast majority of its customers. Tesco can not have it both ways, this particular manager has been extremely foolish in identifying the repeated overcharging of the individual as a reason for excluding them from the store. Any reason whatsover could have been given but this.
Tesco wish to have the policy in place to lure customers into its stores in the belief that they are confident in their pricing integrity but do not wish to fulfill the promise when called upon to do so, that in itself is misleading advertising.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0 -

Why wouldn't you buy four joints together? Here's a stack of reasons why you might
1 Large Family / friend's get together
2 Filling the Freezer
3 Have the money available now and want to buy what you can while you can afford it
4You fancy a decent roast a couple of times a week

Have been thinking about this in more depth and have concluded that as usual Mr T's managers are completely dopey and have not taken any account on the law, here are some of my reasons :
1. Assuming you have shopped at Mr T's and have several of their products, at the point of sale you enter a contract for the goods sold which have certain statutory rights bestowed upon them, for example, if the goods are of poor quality, faulty, etc. If you are banned from the store then how are you to take action if an item previously bought turns out to be sub-standard, if you are unable to go into the store. OOOH DEAR MR T did not think of that, TUT TUT !! :mad:
2. Assuming you have a clubcard then as part of the contractual terms when a sale is made clubcard points are obtained which can if required be used to purchase items from Mr T's store. OOHH DEAR MR T did not think of that, TUT TUT !! :mad:
3. If you have a product bought previously within the last 28 days you have the right as per Mr T's policy to return it for a full refund, as this is standard policy, then if this were required MR T would again be in breach of contract. OOHH DEAR MR T did not think of that, TUT TUT !! :mad:
4. Under the sale of goods act, an item must be fit for purpose, of merchantable quality, etc, if this is breached how can it be redressed without a store visit. OOHH DEAR MR T did not think of that, TUT TUT !! :mad:
5. Under the law of tort, Mr T's owes its customers a duty of care, for cases where a defective product has caused harm or injury, ie glass in cheese, snails in ginger beer, etc, how can the initial complaint be made if not to a store. OOHH DEAR MR T did not think of that, TUT TUT !! :mad:
Do you think that these muppets actually think before making decisions, or do they just assume that all customers are complete and utter idiots and will accept whatever they say. :mad: :mad:
I'd suddenly have a lot of sub-standard products in my cupboard, if you know what I mean.:mad:

I'm sure they wouldn't kick you out if you explained that you wanted to return some items (assuming you explained your intentions calmly when challenged so they couldn't use the excuse that you were being abusive etc...).
I doubt they would open to the idea of letting you in for the weekly shop and allowing you to scour the meat/dairy aisles for products mispriced by 1p/kg!0 -

I have heard they are planning a change of the wording of the refund and replace policy again.
And if things don't add up!
In the unlikely event you are charged a higher price than that on the shelf or the product, we will refund your money and you can keep the product, or alternatively we will ban you from our stores throughout Britain and make a general fool of you in public prior to you being unceremoniously ejected by the Tattood Fatty (security personel)!
(This does not affect your statutory rights)
(Statutory rights are not stocked at Tesco stores)
Please note our managers are authorised to beat you with a sockfull of porridge in the event you are found loitering with intent to check prices!Four guns yet only one trigger prepare for a volley.Together we can make a difference.0 -

UUUUuuuuummmm ? This has one fundamental flaw ! Mr T's store managers, Deputies and CS's, don't know, understand or just ignore the law, on a more often than not basis. :mad:0 -
Seems Tesco are really starting to show their true colours.
There's absolutely nothing wrong in buying 4 of anything - the only limit one needs to abide by is six of any one item. TBH you've got to but at least 3 of any misprice to make it worth your while to wait for the refund (unless it is an expensive of course item eg a DVD box set).
Given that my local tesco have wrongly refused to refund items in the past and always mess me around without apologising for overcharging, I rather enjoy it when they have to give me money back - especially as they abuse their market power so much, and abuse customers by overcharging and sneaking in price rises.
Recently when trying to obtain a refund CS infromed me that they are unable to do these now, and have to wait for the manager. It took 15 minutes for the manager to appear, who then proceeded to examine the products and SELs in incredible detail for another 10 min at least pretending not to know what the problem was. Then I had to go through a 20/30 questions process/ Nazi interrogation about why I needed so much of the item etc etc.
After that they decided to offer me the goods at the cheaper price, I then pointed to the sign behind them which clearly annoyed them immensely. :rotfl:
There were clearly trying to waste as much of my time as humanly possible, and trying to intimidate me as well. I don't care as at least it means the manager is wasting his time too. I could do without the intimidation though as I have been ill almost all of this year and I don't have as much fight in me as normal.
I won't bother complaining as the manager will probably get a promotion for such behaviour. My guess is that they must have recently been set targets for the amount of refunds to give??
Fact is that i could have bought many different items with 1p differences but choose not to do so. I hate to think how they treat people who complain about these.
Have to say i feel sorry for the guy who got banned - fancy being banned for pointing out that they're overcharging customers. :wall: I suggest we all boycott that particular store or just go there to buy mispriced items and nothing else. Anyone know which brach of Tesco it is?
Seems incredible the variety of responses people get in different stores - from refunds and apologies and extra compensation, to outright bans. Absolutely crazy.0
