Head Office have now reminded them of the policy, they also apologised, and sent me all the money i was owed in vouchers. Thanks to !!!!!! Dastardly for his advice on the matter as I wasn't sure I'd get anywhere.
Certain Tesco stores might be run by rather nasty idiots, but the majority of staff at head office are very helpful and probably hate the idiots more than we do. :rotfl:0 -
Yes, Joel I agree that the sign behind the counter is as you stated, but I have had a conversation directly with your customer services manager at HQ on this subject matter a while ago. I was very specific regarding the matter, the scenario was as follows : I have been sold a DVD which I was going to give as a present, I no longer require the DVD which has been sold to me non-wrapped, I also explained the issue of illegal copying of such material and your policy on the boards, which you have shown, as the item is now duplicated (ie present already received) wish to return for full refund within 28 days, the manager at CS central HQ then went through the manuals at HQ for quite some time and concluded that the Tescos policy that applies is as follows :
If the item is returned in its original condition with the receipt and within 28 days a full refund can be obtained, even if the item is a DVD, GAME, or CD.
I have previously queried several sales of item both at and checkout and at customer services regarding CDs, Games and DVD's that are sold by Tescos non-sealed, for which there are a number. Always the same outcome has prevailed, valid receipt in original sale condition equals refund if required.
Obviously if someone strolls into CS with a opened box that is sealed on every item in the shelf, then thats going to be a little more difficult to prove in your favour.
Obviously you are trying to do your job but it seems to me that the whole way in which policies are made, displayed and performed are totally INCONSISTENT from store to store, HQ to Store, CS person to CS person, manager to manager. In short its diabolical. Thats why everyone has been so aggravated by the R&R policy. I for one would been considerably less enthuiastic about stiffing Tescos at every opportunity, if they had treated me with the respect that a loyal customer had deserved. They have not they have turned a serious FAN of Tescos, (could not have praised them more highly) into someone who absolutely totally and utterly detests their appalling, disgraceful attitude, illegal and downright criminal activities, (EDIT : AND OFTEN A TOTAL LACK OF INTEGRITY, BLATANTLY LYING TO AVOID AN R&R), within the space of a couple of months. That seems to stem from a total lack of system and process control, which until recently I have been blissfully unaware of due to trusting Tescos implicitly, while giving my bills a quick check never really examing them in detail.
Just imagine to yourself if it became public in a wider forum such as a TV report, a newspaper, or some other highly public forum, what the impact on Tescos would be. I feel there would be some seriously explaining to do, and there would be a considerable number of seriously annoyed customers.
On the subject matter of the without receipt item although I'd like to get you an image of the said poster / notice behind CS desk on poster along with other policy statements, it would simply be to difficult, I will attempt to jot down the exact phrasing at some point.

The phrasing of the board also confirms what I have mentioned and HQ person is correct. It says 'We may' not 'We will', thus confirming if the item is in its original condition, ie it has not been opened or copied then there has been no licensing issue infringement.
Edit : it is obvious that the precedent has been set for CDs, etc in that a return of a sealed item is fine (ie in its orginal condition of sale), thus the same should apply if the item is sold unsealed (ie in its original condition of sale).
Personally if I were a large company like Tescos I would refuse to stock any CD, DVD, GAME that did not come sealed due to this issue. They'd soon sort it out then, this I feel is caused by a lack of precautions and due diligence on the supply side, given the obvious copying/licensing issues.Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

Edit : which if it came to the crunch a legal expert would. The onus would then be on Tescos to prove the condition was not original, and if the shelf was full of opened items the Tescos case would be dead as REME-BOD's useless albino guard penguin, called PETER. :rolleyes:Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

I'd like to thank MissG, ampersand and --Tony-- for the most useful advice.
Called H.Q. who informed me that Macclesfield Tesco C.S. where in the wrong.
So full refund after a second visit :T, although the manager said that because I noticed the over charge whilst still in the store, they have the right not to use the R&R :mad:. She would not agree with me when I said that once money had exchanged from the customer to Tesco that is when the over charge takes place, not when you leave the store! :rolleyes:
Does anyone know if Tesco T&C are online?
The only T&C I can find on Tesco.com is for online use.

I've heard people mention that has been said before as an excuse and apart from them talking nonsense as usual, all you have to do is walk out of the doors and straight back in again - you've left the store then0 -

The contract is at Point of Sale, not at the exit point of the store. I have had a similar argument on this subject. :mad:
Also on the reverse, that I had gone from the store and then later come back, which I did not as proved by the CCTV, still it makes no odds anyway. Given the items where not stickered ones (I suppose implication is the if you have an item mispriced due to a sticker issue, they can try to say you could have been gone to car or house where the obvious stack of Tescos stickers are waiting to be put on and then returned the item).
There are a considerable number of Tescos employees who are to be blunt LIARS and will attempt at all costs even that of slandering customers (a civil offence), and abusing and harassing the customer (criminal offence), etc in order to avoid their responsibilities. I have said it once and I will say it again they are a DISGRACE. :mad:
