It was taking some 7 days at least for someone to come look at it, but he did say i'd be best returning the PC. ( only purchased it last Saturday!)
He also said they have withdrawn the PC from Tesco's. (but is that because of the pricing error or perhaps a bad batch? )

I am going in, either to get it replaced (if they have any) or select an exchange!
So will i be entitled to the overcharge of £446 or the box price of £349.93 against the exchange??

    Any ideas anyone?

I would say £349.93 as that is the price that the product should have been.

But I don't man a CS desk in Tesco (Thank the Lord, else I'd have to face all of you lot;) ). I think they'll offer an straight exchange if they have the stock, or if you want to upgrade, they'll probably ask you to pay the difference.

I don't think you have much of a case to fight asking for a refund equivalent to £446 as that implies you were happy to pay £446 for the product, which you weren't as that's what they originally charged you!

What about Merchantable Quality? The item must be fit for the purpose it was sold, surely

If it wasn't fit for the purpose, it'd be faulty ;)

It also opens up new doors like if it was an inheritant fault - and I (being a CS bod I am) have to prove its not an inheritant fault, and prove that you couldn't be bothered to read in the instructions correctly and use the item correctly.... which I have caught many people out on.

The amount of people that come back and slap things on the desk and say "ITS FAULTY!", and a lot of the time they havent read the instructions or bothered to open all the packaging and realise that the little 'missing' bit is actually in that packaging you threw away...

Ah, the joys of CS :D
Yes, I work for Mr T, but anything I say is not given as an official response or representation from Mr T, and is usually best taken with a pinch of salt, lightly toasted and served with a chardonnay or rose wine. Mmmmmmm.

As for the overcharged person with the faulty PC - it depends.

If you got a full refund for the overcharge, Tesco will exchange the item for you, and you're not *likely* to get another refund.

You may get offered something different if the same item isnt in stock.

We can also repair the item, or ask someone to take a look at it/test it within reason.

Yes, you are technically entitled to your money back (in cash) if the item is faulty, but we of course could say that you didn't actually pay (or pay the full price) for the item - but it doesnt mean to say it waivers our rights to dealing with faulty goods, only just perhaps the full refund part.

It'll be interesting to see how the duty manager deals with that though (as exchnages/refunds like that are normally out of a usual CSA's reach, and have to call on duty) ;)

  • Has the policy wording changed?

I noticed today in Stalham (Norfolk) that the wording is now along the lines of "In the unlikely event that we charge you more than the shelf or pack price...."

Is this a change, a case of a bloody poor memory or simple paranoia?

It's been that wording for a while now. I think it changed to that around July in the 3 Tescos near to me.

Ah, No? Merchantable quality and a product being fit for the purpose it was sold is also about buying something because you were led to beleive that it would do something or exhibit properties that it will not or does not.

Taking an extreme example, if a grocery staff member told you that adding these Apples that are on special offer to a pork stew would turn the mixure into a bright shade of purple and it didn't, they would not be fit for the purpose that they were sold.

I guess that you would need to have taken some advise from an employee to be able to claim this. However, there's a reasonable chance that someone might buy a PC, a freeview box, toaster, etc for a particular purpose having been advised by staff only to find that it's not fit.

    Just got back from Tesco's........
Told her the full story of getting overcharged then faulty PC etc.........
She went away and came back with a Manager, she said that as i had already been refunded the £446 that i could either have a swap or she could refund me the original box price of £349.93!!!
Not being greedy i took the computer, she couldn't have been any nicer!

  • Was at my usual Tesco's yesterday in the North or England. They refused to do the refund and keep product on some meat - only gave refund. Two big fat blokes basically told me where to go and that I wasn't having any more free food out of them and laughed at me and were very aggressive. I certainly have had quite a bit of stuff, but nothing like a free PC or anything - probably little more than £100 worth in total (maybe averaging 20 quid over 5 visits). Also said I could contact head office if I wanted.

Anyone else in this position? I suppose at least I haven't been banned, though I don't especially like Tesco so it wouldn't really bother me if they did that. I don't really like annyong people too much, but given the way they treat me they certainly deserve it (tthe same members of staff even had significant attiitude problems before I started checking for misprices).

Should I contact head office or will they ban me if I do so? Maybe Trading sStandards would be a better option? I'll be shopping at Sainsburys from now on given the way tesco treat me. Whilst it concerns me that they refuse to honour what's written on the wall right behind them, it's the abuse and intimidation which is what annoys me more than anything.
