And ..... that sort of action got me nowhere and the idiots got away with blue murder.
Great advice......  [/quote]
What I was suggesting (not advising - I'm not legally qualified, just an interested observer) was that I would weigh up the time and energy likely to be needed to continue against the chances of losing and also the stresses of getting caught up in a court case. AFAIK there isn't really a point of law at stake here.
Sometimes you just have to look at what is really important to you in life. I really hope I would have not got myself into this position in the first place.
If I was in the position of ICE I would also be tempted to walk away, but they may see this as an attempt to defraud and also be standing on principle. Besides, they are currently in possession of the money. They should also be weighing up the costs of the court and the chances of losing, and the chances of appeals if they win! It could cost them a lot more than the cost of the unit even if they win.Always another chapter0 -

Meanwhile others have moved on and got the things they wanted as well. Me, personally had a flash trigger device go wrong this year, after owning the product for around 18 months and I returned this, with a return number to the place I bought it from and it was replaced, with gratis items within days. This way of doing things is not exhaustive or trivial. In fact if OP had bought the radio he blew up (IMO) from a car accessory place, would he had driven back there to get it exchanged?
So being right and not getting a refund are in fact, poles apart.0 -
Guess you guys are right.
I'm just a tad (bit more if honest) that I weakened and didn't pursue something, got threatened and gave up. Looking back, if I'd had the time, energy and money, I wouldn't have caved in and fought against the so and so's because I knew I was in the right etc etc. Plus alot of other people were in a similar postion too.
But, there you go............Genie

I don't know your specific circumstances, but it seems you are saying you were in the wrong to give up. I wasn't saying you were in the wrong and it was that which created the circumstance.Toyota - 'Always a better way', avoid buying Toyota.0 -

Sorry, I am not trying to contradict you at all, I am agreeing with you that maybe you shouldn't have given up.

You would really have had to read this thread following the prior threads the OP posted (Oh yes he has been hanging on for that long), as i would rate 90%+ (to be fair), said he should just return it and and await a refund.
The Majority have gone beyond the point of offering advice (for fear of being branded a Troll or not offering the advice he WANTED to hear), to simply awaiting for the MASSES of EGG on face, from either side of this saga.
I dont know what the odds are on the case of him winning, but I certainly wont risk gambling in his favour, Im eager to hear the final outcome, but fear will only know the finality from the OP, if it rules in his favour, else i can only await a new thread entiled "Martin Lewis IN PRISON" with the first post saying "Only kidding, but ICE v TS BLAH BLAH BLAH":A:dance:1+1+1=1:dance::A

Somethimes it is not right and wrong, but these do somehow get in the way of a resolution to the problem. No one is actually getting on to you or your concerns and as it has been mentioned, maybe others would be able to afford advice on your concern in another thread.Don't worry about the thread, there'll be an on topic update soon.
I think somewhere the needle has got stuck though!:rotfl:0
