    If the facts supported it, and they'd kept your money and supplied faulty goods and wouldn't deal with you then I would agree. But you've taken the path of most resistance to test out your layman's interpretation of the law. They have not refused to give you your money back, they just want to check you haven't broken it yourself before they do. Yes, it's a pain they expect you to pay postage up front and then get it back, but if you were so confident it was faulty then you'd have got it back.

    You're a bit of a lone voice on this one - you may have to consider the reason for that. And it's nothing to do with trolls, that's a coward's answer.

    For the life of me, apart from MD suddenly completing Law Exams since last Christmas, what a link to that post was about, unless it is to show MD knows about the law of common sense more than most that have commented.

    The main fact remain as follows:

    The heading of this post was intriguing at first, hence why most people popped in and had a look see. Alas, it is one individual taking on a company because of their self centred belief that they, above all are right and wish to expend as much energy and time they like, just to show boat they feel that way.

    The law of common sense went out of the window, when it was pointed out to MD, quite early, that maybe he did have a faulty unit, but it failed after it was imo badly fitted to their car. ICE quite rightly asked for the goods back, so they could either repair or replace, but MD stubbornly refused to get up and go to the Post office, instead sit on their high horse. Now over 9 months later, MD still is no further nearer a resolution to this business, though he has told us on more than one occasion when he thought he had won, and delighted at this, until he realised he had not yet won anything and the eggs he had so enjoyingly counted, were covering the ground strewn from the basket. By then most of us had decided to either just dither around the thread and move on.

    Along came Hev, new to the thread, and offered their advice. Again and not being the first to see the Bingo caller shouting ‘HOUSE’ said almost the same as the rest of us who imparted the same.

    Maybe, but if we all roll over and give up when we know we are right (like I did... not proud), then its a bit sad. Brits have a tendency to 'accept' what we are told and then we go around moaning about it.

    I've edited in one word for how I think it should have been put.

    Walking away wasn't the right move, but neither is the ridiculous stubborness of MD. He should simply send the item back to be tested, then get his refund. IF they then choose not to refund him that's the point where he should have been thinking about court action. It almost seems like he was frothing at the mouth at the prospect of a day in court before the tiem was even delivered. Are we all forgetting the point where they offered MD exactly what he wanted but he responded by demanding an extra 7p (which alter changed to somethign along the lines of "It had lots of words I didn't understand" but rather than attempt to understand them the bitter counter offer was sent,) honestly, and some people are still buying into the idea that MD just wants this sorted and isn't bothered about his day in court.
