    KitKat editions red berry - reduced to 10p (from about 40p) in the sweet section by the cigarette kiosk & CS

    For Mr T's not to infringe your statutory rights the product is bought as normal, the refund for an overcharge is an entirely separate issue. If you decide to buy something, it is overcharged, and you get a refund as a result, there is nothing stopping you returning it as per Tesco's usual policies. Whether or not the receipt has been wrote on or not. Any such practice would infringe your rights.

    They might not like it but it also has a refund and returns policy directly above the overcharge policy lines, which tells you what the return policy is.

    The purpose of a refund is to reimburse you the money you paid. If you have used the overcharge policy to get a £10 item for free, and then take it back, you should only be refunded what you paid i.e. nothing, because you were given the item for free.

    To let the cashier refund you again when you know full well you have already had your money back is dishonest, and possibly fraudulent.

    It was a lot of fun for me today! :)

    I went to TESCO with no intention to score anything more because I scored most of them in the last few days.

    At the time, I were about to leave the store. I noticed that there were two guys following me. I felt a big strange but kept wandering around the store to see if I need to buy anything. At last, I decided to leave without buying anything. :)

    Then, when I went through the checkout and to the exit door. There were 4 people came towards me including the security man and the store manager.

    Here is the conversation:

    The manager: Do you have a list?
    Me: What list?
    Manager: The list of items? The internet list?
    Me: No, I don't.
    Manager: Are you sure?
    Me: Yes, I am.
    Manager: You don't have an internet list of items, do you?
    Me: No, I don't.
    Manager: Were you here yesterday.
    Me: Yes, I was.
    Manager: It's ok.

    Then I walked out.

    It is hilarious, isn't it?

    So what redress do you suggest for someone like me who had some cheese overpriced, refunded, and went mouldy unopened 2 weeks before its sell-by date? Accept poor quality because it was free?

    I can see what you are saying..... but I think the case of substandard goods (for which your rights should not be affected) should be different from getting say a crate of beer for free and then attempting to return it for another refund under the normal returns (for no reason) policy.

    So what would you do if you bought say a CD and it turned out to be scratched and would not play ?? Say oh well is was free but it doesn't work ? or go back to CS and say I'd like a replacement or refund ??? Or you get home and the cheese you have got is stale ???????

    I'd have told them to not very politely to stop bothering me, reckon they'd have soon got the drift (as I can be fairly blunt) :mad: . Then I'd have rang head office to complain about being harassed, by the individuals (making sure I gave them a real sob story) ;) , thus making sure that I really got them in the brown stuff. :rolleyes:

    I have noticed one guy in particular always seems to be hanging around when I am in (think he's duty manager or meat mgr), probably because I gave him a good old ear bashing the other week on the way to my steak refunds. :D

    Obviously getting a replacement is different, because you are exchanging a faulty item for one of an acceptable quality.

    The point I'm trying to make is that getting an item for free, and then taking the item back for a cash refund is being dishonest.

    funny that, the cheese i had free WAS stale, and the cd i got free was a load of c***

    You were overcharged that's the top and bottom of it. You can't be expected to have a calculator with you to work out the overall pack price, thus must use the kg wieght as your measure. ;)
