  • Thanks to LarryHarry for the advice. I wrote a letter to AMC and Lyle Hill and posted it recorded delivery. I have received a response from them both. Firstly, Lyle Hill state that their company is contracted only to manage the repayment of the agreement with the finance company which is 'Fitness Finance!' (Funny that seeing as I have no contact details and an earlier posting states that Fitness Finance are located at the same address as Lyle Hill!' They then state that my request to cancel membership should be directed through AMC!!! They also state that I should continue with my payments and that I am actually benefiting from 0% interest!! - What a joke!
    I then received a response from AMC stating again that I have signed a non cancellable agreement and they also point out that as of 15th June 2007 all agreements came with Pre Contract Information Sheets and therefore they do not feel that I was mis-sold the membership and no misrepresentations were made! The fact that I thought I was signing for insurance for using the gym equipment is surely a misrepresentation!!

    Well I have recieved letters back from all three companies & exactly as the above post, they say that basically we're in the wrong & they are quite obviously in the right.

    Although I refuse to budge at the moment, I will continue to monitor this thread on a daily basis (as I have done ever since!) to see what others are experiencing..... unfortunately though I can't help feeling naive about the fact that I may end up re-entering the standing order agreements...cos at this stage I feel I have lost! (this is only because I currently see no way out!)

    LarryHarry - you have a golden letter there mate - wish we had those letters too :-(
  • Thanks Pete1210 the letter was from The Millenium Experience stating that they have informed FitLife not to process our credit agreement & to contact our bank to stop any further payments. It was signed by Miss Jane Short (Member Services) The Millenium Experience Ltd t/a AMC P O Box 781 Cheltenham GL51 8WR (another address for some of you to try) but stick with it & don't let the B***ards get you down!!!

    Have you written/emailed your local Trading Standards & Watch Dog. I think if enough of us do that then someone's got to do something to stop this :beer:
  • Thanks LarryHarry, basically I'm just gonna keep an eye on this forum & stick with the original plan of paying NOTHING!

    It'll have to be settled in court to get me to start up again....at the very very last resort.

    In the meantime I will forward all three companies letters to my Trading Standard Officer.
  • We've just received more letters from AMC and Fitlife Ltd. They state the same as Emsicles. I find it so funny that they are now saying "from advice from Trading Standards we have included a pre-contract information sheet.

    ARGH, how many times do we have to tell them that we were not informed, we were mis-sold a product and to leave us alone!

    I'm following the advice from my lawyer (through the union), to wait it out. She said it's going to be difficult, but they'll give up. She said that I need to keep reminding myself that they are sending the exact same letters out to everyone else and that all we've signed is a credit act and not a contract.

    If these people think they're getting a penny out of us, they'll have to take us to court - to which i'll gladly abide!

    If I get anymore letters, i'll ask the lawyers to draft a response to them on my behalf, because frankly, i've had enough of them.
  • Just sent emails to Watchdog and to my local newspaper (Gloucestershire Echo). Just waiting on replies.

  • Hi, I have also fallen foul of this bunch, no pre contract info, carbon copy signitures etc.. Im in Hampshire. I have contacted Trading Standards and followed all the VERY HELPFUL advice I found here and hopefully it will all work out for the best.

    If any of us get taken to court I think we should all team together and be witnesses for each other - there would be too much evidence for us to lose. I hope if I get a summons drop through the door I can count on all of you??! Thanks for all your help and advice.
  • I don't know if i should count myself lucky or not but I've just checked the date i signed my credit agreement and it was April 2007. That means I didn't get a pre-contract agreement sheet.

    in any case, like we have said before, we don't have a contract, just a credit agreement.

    I have read the back of it and it states that
    'you have the right to settle this agreement at any time by giving notice in writing and paying off all amounts payable under the agreement, which may be reduced by a rebate.'

    I reckon that this could be a way for them to settle with us - they could take our letters as notice given and then write off the remainder of what they say we owe as the rebate.

    I also imagine by now, that someone from one of the fitlife companies involved have sussed out this forum and are keeping a close eye on our conversation?
    If so, they could take up the rebate idea as a way of closure for us all here: write off the (disputed) amount they reckon we all owe. They may as well, as there is no way that i personally am paying any more.
    If they take me to court, they face defeat, not only in the court case, but also loss of their own credibility. Extremely high stakes for them - much greater than the amounts each of us owe in monetary terms. Can they really afford to go to court and getting so much adverse publicity? It would be like shooting themselves in the foot!
    I really hope this issue features on Watchdog. They could do with the exposure.

    I intend to sit tight. i have had no more communications back from my email to Fitlife, and no more letters from the other two companies either. It would restore my faith in human nature if I were to receive a letter from them ending the agreement once & for all. Shall I hold my breath???....
  • Reply from Lyle Hill - in a pre drafted letter saying they cant help with my query (I didnt have any query, just fact!) but they only act for Fitness Finance. So its either Fitness Finance or AMC's problem.

    AMC (in another clearly pre drafted letter - they must need to do this alot!) say they cant help and its FitLife Ltd credit agreement so its their problem.

    FitLife IS Fitness Finance.

    Fitness Finance IS Lyle Hill.

    Both have same address as 53c Manor Road, Itchen , Southampton.

    Do they think we're stupid?! Have emailed Watchdog too. There is no way im surrendering to these fools.
