OK, so I've read through my letter back from Trading Standards & they basically say pretty much what others have said so far in this thread.
I just hope in order to help us, that the non-compliance agreements set out by the AMC are the ones that we have signed (meaning of course that they are in breach of new rules set out in the Consumer Credit Regulations Act 2004). This way we have something to stand against.
He too suggested I write a cancellation/complaint letter to all three associated companies & if no satisfactory response has been made, then make a formal complaint to the Financial Ombudsman Service.
Personally, at the end of the day, I have cancelled both SO's anyway. They can threat all they like! I'm in a debt management program anyway, so entering into this agreement should never have happened in the first place!
Hope everyone else is doing well with this?0 -
Hi there. Me & my wife have been in the same situation as most of you; we've had the same letters, the same threats and we most definatley will not be paying a penny.
We joined the gym in question in June on a friday after 5.30 and tried to cancel within 24hrs of signing because of an unexpected money problem.
Apparently we were too late. We immediatly cancelled the DD from our account. We haven't even had our inductions.
To cut a long story short, Laura (my wife) contacted her lawyers through her work's union. They have been very helpful and have confirmed that the AMC do not have a leg to stand on. They have advised us of the info to include in a letter to all parties involved and said that we should include a copy of the following document.

When this is sorted and our memberships cancelled (and only then, we don't want to look stupid in front of the country) I have full intension of exposing this to the public and making them aware. I know some of you wish to do the same, and the lawyers stated that there are other forums other than this one that are looking to do the same. I suggest that we somehow compile a list of victims, we report to local papers and maybe some news programs. They should not be able to get away with this!:T
I also know that some of you are from Gloucester - ditto, so if you want to talk about taking action, let me know - I think we're about to start a war!!!:mad:0 -
I'm all for going public about this-I've already contacted watchdog via their website so hopefully they'll take an interest.
Good to know a solicitor agrees that they won't win ha HA they are going DOWN!!!

Unfortunately we have fell prey to this FitLife/Associated Members scam of joining a gym with only 4 pieces of equipment and some free weights for £396.72 per year for upkeep. Having read through the previous comments needless to say they now have their backs covered by including a pre contract information form which is craftily placed at the back of the original contract so you sign it as a carbon copy. If anyone has any suggestions on how to handle this now please it would be appreciated. We have written, faxed and emailed several times but not had any reponse and am now wondering whether we need to set up the standing order
.

I wouldn't even think about setting up a standing order. They should have explained to you about the non-cancellation and it certainly isn't something you are aware of when you sign the top copy. I have written to them like you & haven't yet heard back from fitlife. I, like everyone else here, have no intention of paying out money to them anymore. They have, as you state, very craftily hidden the info, so stand your ground is my advice.0

Exactly that!!!!! They conned my wife & spoke ever so fast to rush her into signing what she thought was only a standing order mandate, to cover the 'upkeep' of the gym premises - there was, as you say, absolutely NO MENTION that it was non-cancellable at all!
We have sent off our complaint/cancellation letters - if they say we can't cancel, I say we can. I'll see them in court no problem - bring it on once again! Aaarrrgh I'm so maaaad right now!  :mad:0 -
Thanks MaggiePKR - glad to know we have support from other members of the forum and we have no intention of starting a SO. We have informed the Trading Standards in Sheffield and also sent three letters to AMC, Lyle Hill and FitLife Ltd and we suggest that as many people as possible should contact Watchdog and get them involved in this scam.
Is there any others in the South Yorkshire area that have fallen foul of this scam???0 -
I've fallen for this scam too! I'm in Bristol and have joined Elite Fitness in Emersons Green. They did all the usual techniques as others have mentioned above. I have now cancelled my standing order and have received a letter from Lyle Hill stating that I signed a non cancellable consumer credit agreement and that I would be in default of this agreement if I don't pay up. It refers me to a paragraph in the agreement stating that 'The whole balance becomes payable immediately.'
Could anyone forward me a copy of their letter outlining the legal terminology and trading standards requirements so that I can forward this to Lyle Hill and Associated Members Club as I haven't done that yet?0
