    'Revised their agreement'?
They have breached by not advising you of what you were signing - too late to be revised?
Any agreement already signed by us has (unfortunatley in this case) been agreed - again, too late for any revision surely?

    Pete

These people are dark. They are taking the michael.
  • apparently all they mean by revising the agreements is that now they give the pre contract info sheets, which they never used to include at all, but as they are still sneaking us the sheets by hiding them, they are still worthless. Anyway, trading standards have told me to ignore all the threatening letters as they are a load of rubbish.

You should get something in writting then - if they are wrong, who will be left with a debt collector on their back?

I too received the same response from the AMC. They offered to transfer the membership to a friend or relative. Though this would be a painless alternative to cancelling, I still plan the latter.

I just need the correct standing order reference for my wife's membership now.

    UPDATE:

I have just sent a letter back to AMC asking for the standing order reference number. I also told AMC I shall be seeking advice from the Trading standards central website - which I have now done (my local office & AMC local office)

Will post up any movement from this......;-)
  • To Dotsandspots and all who have posted,
I did have my money taken out by direct debit, which I have cancelled.
I informed both Fitlife and Lyle and received a similar letter and info that ann.may has had.
After reading the replys on this forum, I do not expect I have anything to worry about by cancelling my standing order/Direct debit.
In any case I will not be paying any more monies to them, they will have to take me to court.
I am unemployed, nearing the state retirement age and in receipt of benefits, so I don't think the court will force me to pay them.
  • As I have mentioned a few weeks back now I was nobbled by this scam on the 13th May, very apt date! Once realising that I had been scammed I immediately sent them a letter the very next day to cancel both mine and my nieces membership via recorded delivery to the Cheltenham address (which could not be found on the post office system I hasten to add). I heard absolutely nothing in response but neither of us have had direct debits set up and subsequent payments taken from our bank accounts. The payments would have gone out in June so I think we had a lucky escape here and learnt a valuable lesson in the process!!! Who knows what happened here, maybe the paperwork got lost in the post, or they have some sort of cool off period where you can cancel, but dont communicate this to you, either way I am not going to persue it - dont want them realising that 2 got away and as a result we receive debt collection letter and such like. I am rambling now... If I ever see that dreadful girl that conned us..... god help her!!!!!

    Hi Kayleigh,

My wife has also been targeted by Fitlife, they are persistent if nothing else, the latest state of affairs for us is that they have given us 5 days to pay off the balance or pay it off in installments of £10 per month, all very different from the " we're coming to get you " act they started with.

Just one query, when you mentioned just ignore them if they send a threating letter, who said that, as always i think you cant ignore the idle threat, i doubt if they will since this has been going on now for about three months. Anyone who has some advice on this will be greatly appreciated.

    Thanks

Well we've cancelled one of the standing orders/memberships (the one that isn't used at all)
The more I think about it, the more I think I'll cancel the other one too.

They can take me to court if they want - I'm gonna call their bluff & see where they stand against loads of unfairly treated people!

Just waitin on the first reply for cancelling the contract (the contract we knew nothing of that is!)

  • Hi ppl
Thought i'd post my latest too...
I've received a "final reminder" (woo scary) saying that i am now in serious default of the credit agreement - ha - this being the credit agreement which they tricked me into signing, what a cheek! Anyway they said that if i don't pay in 7 days they will send it to debt collectors, who may visit my home or take legal action. That was on the 5th august so I presume they have carried out their threat.

I am so tempted to write back to them again but the trading standards officer has assured me that as i sent an initial letter cancelling my agreement (as in one of my above posts) i don't need to do anything else, and just to ignore them. It's difficult though cos i am soooo annoyed.

So now i will wait for the debt collectors, apparently they will be in breach of the debt collectors guidelines if they hassle me and i can complain to the office of fair trading. Can't remember why they are in breach (lol, it's all too much) but that's what i was told and that they risk losing their debt collector's licence if they pursue it.

Just wondering- to the others who have posted - did you all send a letter cancelling the agreement to fitlife, lyle hill and the amc? If you didn't then you need to do that asap, use the link provided by kayleigh above, which will take you to the letter drafted by trading standards. This is very important.

    Hi all,
I have been watching this thread for a while & finally took the advice from you all: I have written to Fitelife, AMC & a company called ECILtd from Surbiton (I haven't had dealings with Lyle Hill). I have followed the letters that many of you have posted, referring to trading standards etc, and have cancelled my standing order. I like you all, had an under-copy of the non-cancellation policy and didn't realise until my son pointed it out. he had signed up too but made a real fuss, and eventually got it cancelled and all his money returned.
I decided i wanted to use the gym so didn't cancel.
We have since moved and wrote to them asking to be transferred to another gym near to my new address. they wrote back saying there wasn't one and that i had to continue to pay whether i used the gym or not.
I was told that the £16.53 a month was for insurance for me to use the gym, in case i had an accident whilst on the premises, which sounded a good idea at the time. My reasoning is that if i am not using the gym i don't need the insurance.
I am really worried that they will take action against me but i feel i have paid long enough after i stopped using it. I can't afford, like anyone, at the moment to throw money down the drain - i'd sooner give it to charity.
Its good to have found this site as i don't feel quite so vulnerable knowing others are taking the same action as i have. safety in numbers i hope.
    Maggie
