Hi Gina. You should use the bank charges calculator on this site to calculate the interest due and print it off with a copy of the letter. Add anything else to the letter that may be relevant to your case.

    Dear Sir/Madam

    Account numbers: xxxxxxxxxxx

I am writing to you as I would like to request all charges placed on my account be repaid to me, including interest at the rate of 8%, the amount a court would award. I have enclosed a copy of the calculations for you to confirm the amounts.

If you refuse, I request, in writing, your method for calculating these charges as actual costs which the company incurs. For example, how it costs £10 to make a telephone call or send a letter.

You will be aware that I am currently in communication with the Financial Ombudsman Service regarding the agreement and as such, the account should be frozen.

    Yours faithfully

Well I've had £290 of charges refunded to me, although they admit no liability :).

Had a letter from my PPI saying that they can't accept my claim and have asked me to complete a questionnaire. I've sent out letter 2 from this site today.

Just wondering, IF WF did go into administration, and another company bought the books, would the new company be legally entitled to pursue our loans? I only ask as taking out the loan is a contract between two parties, myself and the lender. Can a third party then come in and legally enforce the loan, even though this is not stipulated in the loan agreement/contract?

Yes they can. It's the same as a debt collector taking over the account of someone in arrears; you didn't sign with the DCA.

Been through the same thing I handed my questionnaire back on 5th March and have received no communication from them and now have received a letter from them today dated 26/04/09 advising they have charged me £20 for sending letters as I have defaulted on my agreement my dd is not due til 1st May am really annoyed with them and it is from the local branch where I called to give them a piece of my mind - have sent everything to the FOS and hope they can do something as I have asked them for a statement of my account and am still waiting.....

So mad at them so I may use your letter too sol

So you've made a claim for PPI and charges? have you heard back from them regarding either of your letters? Did you send it recorded?

Yes I got a questioinnaire on 5th March and sent it right back and also have received nothing but grief from them phoning me constantly at work 13 times on my mobile between the 25th March and the 31st March and again in APril am sick to death of them pestering me and just want some good news as I could really do with it. My balance on my letter was actually more than I had initially borroed and have been paying it now for 2 yrs so am baffled as to what they have actually charged me!

The first thing you should do is send them a letter advising them to stop calling you as you deem it as harrassment. Send it to the head office and ignore the branch.

You should also remind them that you are still waiting to hear back from them regarding your claim for PPI and charges.
