  • I just wanted to say a huge thank you to everyone on this thread. I too was receiving letters from these criminals and I sent the "prove it" letter.

    Within five days i received a letter stating they could not obtain copy of original paperwork and as such the debt would no longer be pursued.

    I would urge everyone to fight them at their own game....

    Well Done, It just worries me that for everyone who finds their way to this or similar sites and gets the information and help to beat these sharks there must be many more folks who get stung.

    By get stung, I don't mean those who take on credit with the intention of trying to get away without paying but the genuine cases where people have fallen on hard times, become ill, are Elderly or become victims of mistaken identity.

    I know that when you are old School, brought up to believe in Respect, the Rule of Law and the Bailiff and you get a letter saying what they can do to you (even if it's not true) it's a frightening time. As we know all too well some people are so ashamed and frightened they can't ask for help or don't know where to ask.

    I posted somewhere the other day about Martin visiting a School to talk to the pupils about finance and debt. If I could I would pay for a prime time advert to tell people about this place.

    So untill I win the lottery :rotfl: Spread the word folks, if you hear of someone in financial bother, they may be elderly and not have access to the web, tell them about MSE or take up the case on their behalf.

  • Our tracking thing for recorded delivery for the CCA is now showing on Royal mail site. So at least we know they definitely received it!

    Keep those details to one side - it's very much worth retaining them.

    Now that they got the request, and if they fail to act on it, chances are another agency will pursue.

    But you just refer them to the request you previously sent, and no, they can't have a copy of it.

    Sorry hadnt properly read your post properly, Do we just RE-SEND the same request (but without another £1 postal order, as I'm not paying for it again lol And if another Debt company does chase it, Do we then send the Prove it letter? OR have we then gone into dispute?

    No. Do nothing. You have proof it's been received. Once the 12+2 days have elapsed, it enters into dispute status.

    Until the request is carried out, you have no obligation to correspond with the company - or any other company that gets involved.

    They've got the request, now it's their problem, and will stay their problem until it's carried out.

    Yes. You have a legitimate reason for not paying them.

  • Oh am so angry right now. After receiving a letter last week from these criminals stating that they were no longer chasing the debt as they couldn't source orginal paperwork, I received another letter today chasing a debt for nearly £4k for barclaycard - arrggghhhh....again I haven't had an account with barclays for over 11 years and certainanly heard nothing for more 10 years.

    Shoudl I just send the prove it letter again...i am starting to panic again that they are going to send the heavies around.

  • After chasing down a longstanding agreement with them they say we still owe £700. Then they say, actually the account agreement says interest frozen but we've been adding interest. We'll scrub the outstanding debt, and you can cancel the Direct Debit you have with us.

    Wait a minute, what about all the overpayment?

    Ah well er um, you can't have it! Actually we didn't freeze the interest so actually it now our money but you can still cancel the DD and the £700 outstanding is still scrubbed.

    Yeh, right!

    Quoted the Consumer Credit Act to them and now awaiting their reply.
