  • Congratulations! Well AK should have received our letter this morning! wonder what will happen now! time will tell.

    How long is it they have to respond? 12 days? 30?
    Just to let you know I got a letter from AK saying that this debt is statute barred, and they will no longer pursue it. Thanks to everyone on here who gave me advice. Hopefully I wont need to send any more letters!!

    12 days, plus 2 for postage. Once that elapses, the account enters a dispute state, which does not rescind until they send you the paperwork you've asked for - and even then, that paperwork may not be legally enforceable.

    But if AK - or any other agency - contacts you in the meantime for any other reason than satisfying the request you've made, report all concerned to the OFT, the Financial Ombudsman Service, and Consumer Direct, since pursuing a disputed account is a no-no.

    can anyone help me pls

    i got a letter from aktiv kapital via BCW
    a legal notification says i owe 2800 and documents can now be prepard for court action says i can pay 127 a month?????? to aviod this
    i cant rem anything of this debt and nothing about is on my credit file which i thou was strange ? wouldnt a unpaid debt be on ur file ,i thou it would be but im no expect

    There's a 'prove it' letter somewhere on this site that you can use. I'm not sure exactly where it is myself, but I'm sure someone will be along shortly to point you to it.

    But one vital point to make is - do NOT provide any signatures for any letters you send to such companies.

    If the company can't be more precise about what debt this is supposed to be for, you can choose to ignore any correspondence from them.

    It could well be that the company is on a 'phishing' trip - ie. they send post to everyone with a similar name to the actual debtor within the same city, hoping that one will bite - and the fact that there's no credit file entry for this leads me to think this is the case with yourself.

    Even if the debt's not yours, the company isn't chiefly interested in that - they just want someone (anyone) to pay them.
  • I just wanted to say a huge thank you to everyone on this thread. I too was receiving letters from these criminals and I sent the "prove it" letter.

    Within five days i received a letter stating they could not obtain copy of original paperwork and as such the debt would no longer be pursued.

    I would urge everyone to fight them at their own game....
