Just a quick update, I contacted consumer direct, who then told me to call National Debt Advice Line, which I did. They said to me that its more than likely that the letter from BCW was on its way to me anyway and my letter arrived on the same day. As for them getting my ex-directory number, they say that there is something odd there. The data protection act might be breached. My next move is to contact the Information Commissioners office and see what they say. All too coincidental that I have had this number for 3 years and then I apply for a BarclayCard and then I get letters and phone calls. Like I said to the guy at NDA, if they wanted to find me, they could. I have been on the electoral roll for 5 years here in the sunny south east(!!) and I have opened bank accounts too. I will wait to see what happens in the next few days. Will complain to the FOS and Consumer Direct (again) if they call me or they send a letter other than one with the words "Case closed" somewhere in it.
Oh and I just checked the status of the recorded delivery letter to AK, and its apparently still being delivered. I seem to be having mucho funo. I will contact Royal Mail and see what exactly has happened.0 -
Hi, I wonder if anyone might be able to help.
My other half has been paying a debt off through Thames Credit-Akiv Kapital since December 2006. Like many others He knew he had the debt and we just phoned them up, wrote all the details of phonecall down and Made an agreement for paying it off. BUT A while ago they tried upping the DD payment amount to more then what had been agreed and without ASKING, so my other half cancelled the DD but it was only for a few months, (3 at most) eventually the agreement was reissued, BUT when the letter came through the balance had Sky rocketed. They said its cos the original agreement was cancelled by us, WEll maybe so, but they were the ones trying to take more money then agreed. Now we have received a Statement (the first we have ever received) And the outstanding balance is now more then the original debt was for those 5 years ago! Turns out interest is being charged on the account
What can we do about these animals?0 -

Hi, read the posts on this thread back over the last few pages.
Seems to me like you need to request your CCA and letter of Assignment for starters. There was a similar post to this on one of the other threads yesterday. You need to see if the original agreement allows a third party (Aktiv) to charge interest, of course if they can't produce the original paperwork you then have the grounds for a complaint or tell them to go whistle.
All the help you need is on here and no doubt someone more savvy than me will be along soon with firmer advice.

Thats what we thought, BUT I wasnt sure as we had been paying them for so long already if we could do a CCA on them now?0

Yes you can. You can submit a CCA request at any time, and you don't have to tell the DCA concerned why - doesn't matter why.0 -
Thank you, I know i've probably read it a good few times over on these pages, BUT When applying for this, what should we be looking for if they respond with any kind of paperwork? As I've read some threads where they havent supplyed what was asked, and tbh i wouldnt know what would be correct paperwork or not!Yes you can. The original agreement that you supposedly signed. If they send it to you, if you don't have a copy already, the agreement itself may not be enforceable.
If they send you anything, scan the document to PC, and upload the scan to this site (and Consumer Action Group as well) asking the question if it's enforceable or not.
But you'd need to ensure that the documentation has any info that can personally identify you (including any reference numbers or barcodes) blacked out (MS Paint will do this fine).
BTW - do NOT include your signature on any written correspondence to HFO.
If you already have, then one way around that may be to put a slightly different variation of your signature (like having someone else sign your name) on the request letter - so that if HFO try the old Photoshop treatment, you'll know about it.

errrm, I have just had a look at the Statement of Account that was sent to us recently, It states its something thats ment to be sent every year, But this is the first that we have ever had! AND I've noticed theres a date on it of the original agreement date (i'm assuming thats when the credit card in question went to debt collection?) it says 14/10/2001 grrrr how annoying then that If id known then what i know now id have had my other half ignore the letters for another year, would have been Statute Barred then! as he started making payments to Thames credit on 7th Dec 2006!0
