I want to tell her to stop the direct debit and to ask for a copy of this credit agreement but do not know where she stands as she has contacted them and has been making payments, therefore pretty much acknowledging the debt as she didn't know what she was doing and didn't get help at the time and in light of the recently received letter, has no knowledge of ever taking out a loan of this amount especially back in 1983.
Can anyone help/advise me please as I feel a little out of my depth.

Hang on a mo, Handy has had a pop or 2 tonight but has just re-read this post. Just check please that the date quoted of 14/10/2001 is the date that it was passed to a DCA. Statute Barred runs from the date of the last payment to the original lender, or written acknowledgement of the debt. Normally once you miss payments or stop it is 3 months before a default is issued to your credit report and at least 6 months or longer before the debt is sold on to a DCA. AK specialise in buying debts that are almost SB'd that way the get them for @ 20 - 25p in the £.
In my case I defaulted in 2004, in 2010 I get the letter, The Notice of assignment says the debt was bought in 2006. So figure it out.
I don't want to offer false hope. Just make sure you have your dates correct. If like me when it happened I buried my head in the sand threw all the paper work away and ran. Don't even start to think that I still don't feel ashamed.
If I could turn the clock back I would, and I would never have accepted
consolidation on consolidation.

Well the debt was originally my other halfs, so he doesnt have any paperwork from the original creditcard. so we have now drafted a letter from one of the links posted before on here, with supplying proper documentation. I'll be getting a postal order today so can post it all off for him (and no he hasnt signed the letter)
But it just suprised me seeing this statement of account come through cos in all the years we had been paying we hadnt had one before! and they have always been repeatedly sending "80% off your outstanding balance if you can settle within the X amount of days"! letters too.handyman123 wrote: »Hang on a mo, Handy has had a pop or 2 tonight but has just re-read this post. Just to let you know I got a letter from AK saying that this debt is statute barred, and they will no longer pursue it. Thanks to everyone on here who gave me advice. Hopefully I wont need to send any more letters!!0
