I have now recieved a photocopy of credit agreement 5 months after my letter.
What do I do now? .....
Process you should follow is this :-
1. Scan it.
2. Block out any personal details (using MS Paint would do this fine) or any reference numbers/bar-codes that can identify you.
3. Upload it onto here using Photobucket asking the question 'Is My Agreement Enforceable'.
4. Repeat step 3 on the Consumer Action Group and Legal Beagles websites as well.0 -
OK, AK have passed my "debt" on to BCW.... so after a lot of procrastination on my half(!) I decided to send the statute barred letters to both AK and BCW. AK's address is a PO box so dont know if and when it will be signed for, the BCW one arrived the 7th. We shall see what reply I get from BCW. As for AK, who knows. Does anyone have a proper address for AK? Just in case the letter I sent gets undelivered. Also I will let you know what response there is (if any). Oh and on a side point, they somehow got my phone number, which reinforces my "Barclaycard told them" theory, cause my phone number is ex-directory and doesnt appear on any credit report.0

Letters to this address asking for CCA and NOA's usually get a fast reply :rotfl::rotfl::rotfl:. When I did a SB for my stepson I got a reply saying they were sorry for any misunderstanding for any distress caused and that they believed the debt was Statute Barred. May have been something to do with saying we were collecting evidence for our compliant to the FOC.BCW just sent a letter saying as we had not sent them £1.00 for a CCA they couldn't reply to us and pointed us back to Activ Crapital. I hadn't asked them to supply anything, my letter to them only stated we had applied to AK for the paperwork and as we believed that their internal comms were useless we had informed them that the account was in dispute.

PS, Send your letter Recorded, It's worth it to make sure they get it. Keep the tracking number, that way you can prove that a staff member signed for it.
Any letter that you send to a DCA, make sure that it is not signed, and no signatures are ever provided to such companies.0 -
Thanks for the replies, I did send the letters recorded delivery, I now have a letter from BCW stating that if I do not contact them, they will do a "personal visitation" from their "Debt Investigation Unit". Should I forward it to OFT and trading standards? As the date was the same as the day they received the letter it seems a bit suspect. Whats my next move??0

You are communicating with them, in writing and you want to keep it that way. Remember to follow the advice given by the other posters and you won't go far wrong. Adapt the letter to suit your situation.

If it was a CCA letter you sent and you know they got it, report BCW to the Ombudsman Service (as well as the DCA's client), Consumer Direct, and the OFT.0 -
I added this to the end of the letter, does it sound OK?
"Also please find an amended copy of my original letter with the correct reference number stating that this debt is statute barred. This, along with my letters to you and Aktive Kapital in addition to any responses, will be forwarded to Trading Standards, Consumer Direct, the OFT and the Ombudsman Service. Any further written communications from you will also be sent to the above organisations. To reiterate this debt is statute barred and I expect no further harassment either by phone or by letter by your company or by your client."
The AK ref and the BCW refs are completely different.0 -

Hi Mazzy, sounds good to me. No doubt FTW and Chippy will be along in a while to say if they approve. The main thing is that they now know that you know (sorry it always makes me smile
) your rights and this way they will treat you with respect. Did you know that every time a DCA gets reported to the ombudsman it costs them money regardless of the outcome.:T
