    Muckerboyu - You should write to them making an official complaint. They are taking more money from your account than was agreed (give details of charges incurred). Inform them that you are notifying them that they may no longer take funds from your account and require them to remove your account details from their records. State that you will set up a standing order (not direct debit) if they provide you with the relevent account details.

    They are not allowed to take more money from your account than was agreed. I would have thought that the bank would have been able to do something about it so i would also write to the bank asking them to assist and if they are unalbe to do so, to inform you as to the reason why.

    Marwood - It may be best to get the details from Credit Solutions. If you were to send a subject access request (SAR - cost £10), then under the Data Protection Act, you would be entitled to a copy of all the data they hold on you. This would include payment details as well as correspondence. I would then send a copy of this to AK and inform them that they are in breach of the DPA for processing incorrect data about you - they are now required t ostop processing your information and confirm that your data has been removed from their systems.
    As a result of the above, you should now consider this letter a statutory notice under Section 10 of the Data Protection Act to cease processing any personal data stored on your systems/records and data relating to this account with immediate effect. This means you must remove all information regarding this account from your own internal records and from my records with any credit reference agencies.

    Should you refuse to comply, you must within 21 days provide me with a detailed breakdown of your reasoning behind continuing to process my data. It is not sufficient to simply state that you have a ‘legal right’; You must outline your reasoning in this matter and state upon which legislation this reasoning depends.

  • I used a copy of the letter posted by Harassed as i had received numerous letters over the festive period from Aktiv Kapital.
    They were chasing £233 from GE Capital apparently and were willing to let me settle for a lower sum of £150 or they would be sending an agent to my house.
    This morning I received a reply from them telling me that they had bought the debt from the original creditor but that the original creditor could not provide any evidence of the credit agreement between myself and them. They are no longer trying to chase this 'debt'

    Total scammers!!

  • They just phoned me up on a number I have not given them. They claim Equifax gave it to them. This is a new number which
    was only put in place in October.

    You don't have to entertain them on the phone, and it's best if you don't. Just keep repeating 'Only in writing' over and over to them until they go away.

    Or, send them the telephone harassment letter.
  • Hi, I've been reading this for a while now but I'm afraid I have no idea about what steps to take after seeing people in similiar situations but receiving different advice...

    We've just received a letter from Buchanan Clark & Wells regarding 'a private matter' on behalf of Aktiv Kapital UK, we think this may be about a store card with Arcadia which we thought was paid off.

    The store card was taken out around May 2006 and anything bought/paid for would have been shortly after.

    We've since moved address and so we're not sure if they have been trying to contact us. Luckily, we only got back after 5pm (closing time for Buchanan Clark & Wells) otherwise, we'd have probably phoned them.

    Now, do we go for the 'prove it' letter or do we ignore them?

    Right now they are just asking you to contact them. I would ignore them until they specified what it is they are contacting you about. They may be on a fishing trip so if they're not sure you are the people they are looking for, why should you contact them?

    Also if you were ever to contact one of these DCA's, you should do it in writing. If you ever need to contact them by phone, make sure you withhold the number.

    I've got the letter that Credit Solutions sent to me detailing that the account was paid and now closed. I have sent this to AK, but I will send it again with your enclosed quote!
    Funnily enough, I had a couple of calls from them, promptly ignored and have just received a swanky flyer from them advertising their new payment deals, again promptly ignored and binned. I will also keep the FSA and OFT informed of the details and will keep you posted... Thanks again GeorgeUK

    As with GeorgeUK. Ignore until (or 'if') they're more specific in what this is about.

    Then send the 'prove it' letter if they do give a clearer indication what this is about - but do NOT sign the letter, send it recorded delivery, and don't entertain them on the phone.
