Received a letter just before christmas from a debt recovery company Mackenzie Hall in Kilmarnock on behalf of the persuers Aktiv Kapital. The original Creditor is GE Capital for a sum of £519.26 although the letter was offering a REDUCED SETTLEMENT OFFER - our offer offull and final settelment £363.48. Payment to be made by debit or credit card within one week. I called them up as i had no knowledge of this debt and spoke to someone who said it was for carpets bought from Carpet Depot in 2001. The debt had been sold onto Aktiv Kapital and so received a letter which was in my maiden name and for an address I have no knowledge of. This somehow after 11 years fell onto my door. When I phoned the company I told them that yes that was my maiden name but I had not bought carpets from that company and asked her to send my a copy of any credit agreement for me to verify my signature. The person I spoke said that she would send this but I have now received another letter today from Meritforce who are Doorstop Collection Agents and due to non payment they have been instructed by MacKenzie Hall to collect this debt and will be making a visit to my property within 10 days. I called them straight away again explaining that I know nothing of this or did not stay at the address as per the debt and she told me to ignore the letter. Hopefully nothing will happen but going by all the postings I don't think that I have heard the end of this yet.0

Marigold, if you have made no payment towards the debt for 6 years, then it will be statute barred - if it is yours at all. You should write to them rather than phone stating you have no intention of paying a debt that you do not think is yours, and even if it was your debt, it would be statute barred. I would use the statute barred letter as a basis for whatever you send to them though.

I received a letter today from Aktiv Kapital which said I owed barclaycard £512. It was addressed to my maiden name which I have not used since 1994!
Phoned them up and they said it was an account opened in 1994. Now I believed all my accounts from there were closed many moons ago as I didnt owe
them anything (I may even have paperwork somewhere to that effect).
They claimed I owed £100+ but barclaycard added interest and I could pay it at discount of 80%.
I was just about to when something told me to check the internet first so said I would call back later.
Any ideas what to do next?0 -
You have done the right thing and ahould definately have made a complaint to them to the regulators. You informed them that the debt was not owed, gave them time to sort it out and are still pursuing you for a debt that ahs been settled.
You said earlier that you paid off the debt in 2007 - when was the last payment made to the original creditor? Just wondering incase the DCA you made the payment to has no record of receiving payment either. I would imagine that the debt is probably statute barred (if you hadn't already paid it), but was just hoping to confirm.
You're quite right - all you can do now is sit back and wait for the FOS to check through everything.
Ideally, to make it more costly to AK in both time and money respects, any subsequent correspondence or attempts by AK to contact should be reported to the same bodies as separate complaints.0 -

Do NOT pay them!!! They're trying it on, and the 80% discount offer gives away the fact that they know it's unenforceable.
If there has been a full six period where no payment or written acknowledgement of debt has happened, then it is well and truly statute barred.
There's a statute barred letter somewhere on this site, which you should send to them (do not sign any correspondence you sent to them, and send yours by recorded delivery).0 -

See post #1236. Meritforce ARE MacKenzie Hall (MH bought them out in early 2007). The reasons for why they're offering such a discount are also explained in the same post.
But, make sure to also report both companies to the Office of Fair Trading, Consumer Direct, and the Financial Ombudsman Service for pursuing a statute barred debt.0 -
I received a couple of weeks ago a letter from a company called Aktiv Kapital chasing a debt from Barlcays - I haven't had an account with Barclays since the late 90's and had no contact with them whatsoever since at the latest 2000, they are "offering me a substantial discount", if i pay immediately - I completely ignored the letter as I assume whatever had been owed was now statue barred.
I then today receive another letter "offering" me another reduced fee of paying the debt and I would only have to pay £39, otherwise they are going to send their collectors round to discuss payment with me - thats where I start to get really worried. The letter for a start was in my maiden name, a name i haven't been for over 10 years, I have lived at my address for 9 years so why now, why not 9 years ago??
Anyway, not sure of how to proceed do I ignore this, or do I send them a statute barred letter asking them to prove the debt was mine, or do i just pay up and get them off my back.
After some problems in my misguided youth, i have built my credit score back up and really don;t want to go down that road again. I have checked my credit report online and there is nothing new on there they haven't tried to apply a default on there.
I don't want to pay on principal but the debt has come down from £350 to £39 in 10 days - should I just pay and be done with it....0 -

I am paying a debt off to this company which i am responsible for so dont mind paying it, But had origanally set it up for 10 per month since paying this for a few months i have noticed that they have increased it by 15 pounds per month with out informing me.
So what i need to know is are they allowed to do this and because of this increase i have been overdrawn on my bank account 4 times at which i have had to pay 35 pounds to the bank each time it happens. Is there any way i can go back to my original amount and can i make them pay for me going overdrawn because of there increase.
I cant stop the payments as they are taking them as a debit card payment. And the bank say i cant stop this through the bank i need to get them to stop it.0 -
The original debt was taken out in 1999 from Halifax and last payment to them was circa 2000/1. Credit Solutions contacted me in 2003/4 and informed me that I hadn't been paying it which was true. I had a payment scheme worked out with them which finished in 2007 and I have the letter from them saying that the account is now closed. AK, true to form had the wrong details for me, wrong post code etc. Anyway, they say that they have no record of the debt being payed and I checked with Credit Solutions who confirmed I had. I also checked my credit report on Experian and had no arrears listed, all loans payed and finished.
