  • Aktiv Kapital wrote to me today requesting payment of a debt of £81 relating to GE Capital Consumer Finance. From this thread it seems likely this is a scam but need advice on what to do next. Firstly, the letter is addressed to my old married name which I have not used for nearly 10 years. Secondly, I have no idea whether this was ever a legitimate debt as it must have been over 10 years ago to be in that name.

    Should I send the "send me the information" letter or the "statute barred" letter or should I just ignore this completely? If I am going to write to them I don't want to give them my new married name as I don't want anything appearing on credit records that shouldn't be there but equally the person with the name they have doesn't live here (and in fact never has) so what name should I use on a letter?

    Any advice welcome please!

    They are also supposed to send out a statement of account with a CCA request, so technically, they have not completed the request you made.

    Also, if AK have 'bought' the debt, then they should at some point have sent you a Notice of Assignment.

    What you should do is :-

    1) Scan up the CCA (but it's essential to remove all reference numbers, barcodes and any details that can personally identify you), using something like Photobucket.

    2) Create a new thread, asking the question 'Is my CCA legally enforceable'.

    3) Sit back and wait for advice.

    Phinic, if it's not his debt, then he owes nothing and can tell them this is they phone. I wouldn't even bother writing back to them. I would however suggest he keeps an eye on his credit file to make sure the DCA doesn't put this debt against his name.

  • I've recently had dealings with these people and sent them out the stautute barred letter 4 times and no response form them today i recieved a letter from CCS stating they were going to send someone round to discuss the debt or take me to court i found the email addy for Aktiv and stated i had sent the letter numerous times and they had failed to reply why were they now getting ccs to threaten me? i also attached the letter to the email that i had sent in the post. within 3 hours i had the following back
    Thank you for your email.

    We refer to your recent letter regarding the above referenced account.

    We have investigated the issues raised in your letter, and can confirm that legal action on this account would be statute barred under the Limitations Period. We have therefore taken the decision not to pursue this matter any further.

    We can confirm that the account is now closed and you should receive no further contact from us with regards to this matter.

    Please contact us if you have any further queries.

    Hopefully that is the end of all this now x definatley write to them but i reckon emailing is best as you will get a response.
