    You first need to check what the debts are for - send the prove it letter to AK so you can see what you are paying for and more importantly if the debt is yours.

    For the CCJ's, these do not become statute barred.
    After 6 years a creditor will need to reapply to the court to enforce the CCJ, but the debt will never become statute barred if a CCJ has been awarded. For these debts, if you are pursued for the, you could make a reduced full and final offer.
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

  • So how do I check what the CCJ's are for? I tried looking at the County Court Website and it sent me to a page that charged £8 to search for CCJ's so I paid and it just told me that there were two and for how much, not who they were for.

    I sent the 'Prove it' letter to AK and got a copy of an agreement, but it is not for the same amount as either of the CCJ's, so I'm now very confused as to what debt is which as I have systematically paid off all of my other debts (dont know a lot about CCJ's so not sure if one of the debts I've already paid off could be one of the CCJ's)

    As I said previously, I have already paid off AK (via Thames Finance) once before so I dont even know if they are different debts (as both the debts were listed as originally owned by HFC via Dixons)

    I'm not overly fussed about credit rating at the minute but would like to get myself back on track soon, as my first child is on the way and I may need credit in the future.

    The count court website may have sent you on to the registry trust online website. YYou should have been able to get a note of the case numbers. If you contact the court, they should be able to use this to tell you more about it.

    It would also help if you were able to find out what the other debt you paid off was. You may need t osend a subject access request to get this though if AK aren't willing to tell you. This would cost £10 though so i'd wait before doing that.

  • Just a little update....

    Since I asked for advice in this thread just over 2 weeks ago I've received a further 2 letters from Aktiv Kapital, the second which arrived this morning. I've done this same as advised previously, putting them back in the post box marked "return to sender, not known at this address".

    Are these cowboys not taking the hint? are the getting these letters im returning? This is like the 5th letter I've sent back in the last few months! The difference with this latest one is that I can see through the envelope window that the letter colour has changed from white to pink. Is this anything to worry about?

    Luke, if it's not your debt then it's not your problem. Let them waste their money.

    My other half just received a new letter from AK :mad::mad:.

    It's about their "incentive programme called 'New Deal'.

    The alleged debt is for £1,104.56

    If she can pay at least £15.34 per month, she'll get the following -

    £220.91 Kickstart - We will kickstart your 'New Deal' account to get you started.
    10% Aktive Kapital Plus Each Month - We put 10% of each of the payments you make into your 'New Deal' account, which can be used towards paying off the total amount you owe us.
    Direct Debit Bonus - Pay each month by direct debit and we will credit your 'New Deal' account with a further £11.05.
    Match Pay - We will also give you a yearly match pay where we will match a payment you make into your 'New Deal' account.

    At first look, this seems to be an amazing offer, especially to my OH, who's pretty gullible:doh:.

    After listening to her, & making some quick calculations myself, here's what she was expecting from AK -

    They would apply the full £15.34 per month to the debt; meaning a full 6 years + an extra 8p to clear the debt.

    They'd pay 10% of each payment into her 'New Deal' account - over a year = £18.36 x 6 years = £110.16

    They'd pay £11.05 each month into her 'New Deal' account for paying by DD - over a year = £132.60 x 6 years = £795.60

    £220.91 kickstart bonus in first year (as it says in letter)

    Match pay amount each year (as it says in letter)

    So, after 6 years she'd have paid of debt of £1,104.56.

    Her 'New Deal' account would contain the above figures - £220.91 + £795.60 + £110.16 = £1126.67 PLUS 6 x match pay amounts.

    Now, this totals MORE than the initial debt amount; but OH thinks this is what would happen - she'd pay of a debt of £1,104.56; BUT get £1126.67 PLUS 6 x match pay amounts form her 'New Deal' account:j:beer::T.

    Unfortunately, I can't get her to understand this is not the case.

    So, everyone beware; it would seem AK have been to some kind of "stupid morons" school, & are actually giving money away:doh:. Despite the fact we all know AK are morons, I really don't think they'd actually pay you to clear your debt. :think::think:, or would they?????

    Seriously though; please be aware of this new letter, & be very careful, just in case! I have 2 accounts with AK, but haven't received this letter. Makes you think they're trying to prey on gullible females out there. I've managed to persuade OH not to call them; but she's still not convinced about it all :doh::wall::doh:.

    Remember, if it looks to good to be true, then it probably isn't.

It said I owed £600 from a Halifax Loan, which had been taken out circa 1999, (the original loan was for £5000) and they had been trying to get hold of me for the past 3 years depsite having the wrong address details. I contacted them, told them that I had paid this off via another credit company and sent them a copy of the letter stating this I also sent copies of my payment schedule from my bank. I now have a letter stating that Halifax haven't a record of this and they need proof of payments. I have already done this, what do I do now. I don't owe this money, I don't want to have to start trawling my bank details from 1999 to find the original payments and Halifax themselves can't find the loan details because I don't have an account number.
    What should be my next step?

    So you paid this off in 1999?

    When did you last make a payment towards this or acknowledge the debt in writing? Has there been a period of six years or over during which you haven't done that?

    Send them back "not at this address" without a stamp too - that way they have to pay for the postage at their end. When it starts costing them money i'm sure they'll catch the drift.
