Aktiv Kapital (UK) - Who Are They?

Found this forum through googling about Aktiv Kapital and glad I did!
Anyway, a letter turned up at our house about 2 months ago addressed to a Mr James Thirwell. I am the only ThirLwell in my household (my mother remarried and is now Kelly) and after quickly glancing at the name I opened it assuming it was mine. The letter was from Aktiv Kapital on behalf of House of Sterling claiming a debt of £299.04 was owed. After reading the letter throughly I noticed the name at the top was not my own (Luke ThirLwell) but James Thirwell. Unfortunately my middle name is James, the same as his christian name, but our surnames are different, mine includes an L.
Unfortunately this is not the first time we have received mail for this James Thirwell character...
4 years ago, at the beginning of 2006. We started receiving letters from Buchanan Clark and Wells for this James Thirwell saying a debt was owed to House of Sterling. After a few phone calls with them they claimed it was actually me they were after (even though all the letters they kept sending was addressed to James Thirwell) and said I had to prove I wasn't James Thirwell and prove my date of birth (I was only 19 at the time and they agreed that the debt had been taken out before I was 18) then they would close the case. I provided the information and that was that. The lad who I kept dealing with on the phone said if anymore letters ever came for this person just return them 'not known at this address', no more letters arrived for James, sorted I thought.
So back to the present. As previously mentioned I opened one of these letters by mistake and realised it was for this James Thirwell again, albiet from a different debt collecter. So I sealed it back up, took it to the post office and had it returned 'not known at this address'. A few weeks later another letter turns up for James Thirwell, so again, I popped it back in the post 'not known at this address'. Today another letter turns up, popular guy it seems
As they don't seem to be able to comprehend that this person does not live here, I have opened it to get their name and address, and I plan on returning this latest DEMAND, as they put it, with a letter explaining that this James character does not live here.
Is this the right course of action? I assume Buchanan Clark and Wells has sold this debt on which is strange considering they said it had been written off back in 2006. Are they targeting this address again because my middle name is the same as his christian name?, even though our surnames are slightly different? Do they actually think the debt is mine?

No Luke they're fishing. It's a term they use for when they can't find someone and they decide what they'll do is bother everyone else they can find in the local area with a similar name till something sticks. Highly sophisticated eh.
They're not chasing you, but the more you try to make yourself understood the more information you give them and the more of the bait you take. Be more careful about reading the name on the post and just keep on returning to sender. They don't have anything on YOU, it's not a letter for YOU, it doesn't need to be bothering YOU at all. Try not to take it personally kiddo, they're doing this to loads of Jim Thorwells too I expect!
Being only 19 and living at home you probably haven't had the delights of living in student diggs or cheap rented bedsits yet. When you do you'll find the daily return-to-sender mountain can easily be a dozen letters in half a dozen names, you just take it in your stride after a bit.
Nothing bad can or will happen to you. YOU will not be taken to court. YOU will not be baliffed. YOU are not the man they are writing to. It's all cool. Chill and stop biting the bait Hon, you're getting all worked up trying to be a nice boy in an industry of cowboys. Don't bother, it's not worth the phone bill.I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)
As of the last count I have cleared [STRIKE]23.16%[/STRIKE] 22.49% of my debt.

It's not worrying me at all its just annoying getting this spam through our door. Because of my age and still living at home, I've never had any debt, my credit history is pretty bare, just past and mobile phone contracts along with a credit card from my bank. Im just not used to these types letters.
So you suggest not even dignifying it with a response then, just seal it up and send it back like I have previously? Will they ever stop with these letters?0 -
I'm constantly being contacted by these people at the moment too, for a statute barred debt, I've written back with the template SB letter but they are still writing to me, offering settlement deals etc! Totally trying it on!!!!! Glad I have u guys to tell me whats what though and keep me on my toes against these people!Getting back on the Wagon after falling with a thump!

I received a letter from Aktiv Kapital saying I owed them £238.14. I phoned them up explaining that i did not owe this money. Originally the money came off a company from First National. Direct Debit was set up for them to take the money out every month. If i ever missed a payment i either received a phone call or letter from them. I kept up with the payments then all of a sudden the payments stopped. I checked my bank details and the DD was still there in my account. I contacted AK to find out the situation after i explained to them they said i still owed the money. I asked them to send me proof but all i got was I needed to write a letter in, i said I'm asking over the phone, still no response. Now they have passed the debt over to another company who have contacted me, i said the same thing and to get proof that i owe them that money, they said they would check and get in contact. The only response i got was a letter from them saying that I owe the money.
What gets me is....if you owe a company money why would they offer you deals for you to pay half and they will pay the rest, sounds a little off to me.0 -

We had a letter sent to our home about 2 years ago chasing a fictious debt of £856.00, we have consistenly ignored their letters and rude phone calls and they have now reduced the amount to £100, there is no debt outstanding, it is purely a money making scam, don't be led on by their lies!
The best tactic when they ring is to say "hold on a minute I just get him/her, then leave them hanging on. :j0 -
Hey, was wondering if anyone could help me out with this.
I have had letters of AK telling me that I owed them money a couple of times. The first time I didnt know any better and just paid. The second time however I came across this site and have refused to acknowledge the debt.
I followed the 'Prove it' line of arguing and eventually received a letter saying that they were chasing my agreement.
Going back and forwards they eventually sent me a copy of an agreement. However I am not sure if it is for the sum I have already paid. I tried going on to check my credit and there are two CCJ's listed against my name, neither of which are for the same amount of money AK are trying to claim I owe.
I'm now really confused as to whether this is elligible to be SB, whether one of these CCJ's (or even both) are still valid (as I had a lot of bad credit history in the past but have been able to sort most of it out. As far as I'm aware this is the only 'company' still looking to get money.) and generally what to do next.
I don't want to send a SB letter as A) I'm not sure whether it is or not andThe CCJ's were instigated in September '04, so does this mean that SB doesn't come in to play until October 2010?
Any help or advice would be greatly appreciated.0 -
Are you sure that the two CCJs relate to what AK are chasing? If so, then how come the figures don't tally up? Are AK whacking on extra charges?0
