    Have you written to them telling them it's statute barred?

    If so, then complain to the OFT.

    The OFT have put requirement on Aktiv Kapital not to press for payment of statute barred debts once they have been told it is.

  • Hi im a newbie and would like some advise please.
    I am being hassled by these people for a debt from barclays which occurred in 1995 and i have been paying them by direct debit but after reading stuff on here think i may have been able to avoid this as it was more than likely written off.Anyhow i decided to cancel my direct debit and am paying by automated payment £1.00 a month!!well they have rang me everyday for the last three weeks 3 times a day!!i have told them what i am doing and i have emailed loads of times and never get a reply just thier bog standard letters.They keep ringing and ringing and its out of order.I have explained my situation they are getting a payment if it went to court they would get laughed out but they are hasselling me and i cant stand it.Please help :)

  • Vanessajane - I simply got an answerphone and do not answer any calls just let the answer machine take messages. It is much less stressful! x

    Has there been a full 6 year period where no payment or written acknowledgement of debt has been made?
  • I've been chasing a pair of CCJ's from 2006.

    Got my Experian report as I went to a bank to set up a business account but was told they wouldn't let me until I had paid the CCJ's. So, got the report, called the Court and was given the contact details of the solicitor's who handled it.

    To my dismay, I was told by the solicitors that they themselves had sold the debt to Aktiv Kapital in 2007.

    The numbers supplied were not in service so I googled Aktiv and got their website up. The numbers on there worked, but in the automated menu, it disconnects everytime I select the option to speak to a person, rather than pay via automated system.

    I also found this thread on Google and now have my concerns over Aktiv! I settled other debts with them over 2 years ago, for three other debts. To my knowledge they haven't been in contact about the two debts I was trying to settle.

    I'm at a loss as to what to do!

    I suggest writing a letter to Aktiv requesting they provide you any details on a debt they may owe. They are used to people writing to them saying they don't owe a debt, but to have someone come forward and say that they may - they'll be rushing to try to 'assist' you.

    Are you sure that the CCJ's are debts of yours? You can get details of the CCJ's from the court or the registrytrustonline site. It's not unheard of that DCA's allocate debts to someone of the same name.

    I have today received an Experian Report and it says that Aktiv Kapital (BCRD) have linked my address with another address in 2006. There are no other hints of debts and they never contacted me at this address. Obviously, I have asked Experian to remove the link. Is there anything else that I ought to do?
  • It seems the calls are starting again. I have contacted OFT and FOS, but not heard anything yet, I have not called AK back (even though it is important that I do!!!), there is nothing left for me to do now, is there? I jus find it worrying and sickening that they can pursue people like this and get away with it.

    You have done the right thing and ahould definately have made a complaint to them to the regulators. You informed them that the debt was not owed, gave them time to sort it out and are still pursuing you for a debt that ahs been settled.

    You said earlier that you paid off the debt in 2007 - when was the last payment made to the original creditor? Just wondering incase the DCA you made the payment to has no record of receiving payment either. I would imagine that the debt is probably statute barred (if you hadn't already paid it), but was just hoping to confirm.

    You're quite right - all you can do now is sit back and wait for the FOS to check through everything.
