Hi im new to the forum and im just looking for a little advice, im 23 and have graduated a year now im not working in the best paid job but im getting by, i got a lot of stupid debt out when i was a student eg overdrafts, credit cards etc, im now trying to pay it off as i want to start a fresh and actually do something with my life instead of earning pennies and paying out a fortune, i recently recieved a letter from a collection agency called mackenzie hall, acting on i think Akiv Kapital, and who they were acting on i hav no idea, the debt i think it is is almost 5 years old, it is an overdraft with lloyds tsb, i think... that went into default, i havnt made any contact for a long time and they've track me to a new address, although the letter was seeking verification that it was me as it was asking me to ring to verify my identity and begin payment negotiations if so, just looking for some advice i would be very grateful for any help..

Is the debt almost 5 years old, or is this when the last payment towards the debt was made?

Right now i would say do nothing. If they can't be bothered to even tell you what they are wanting you to contact them about then i wouldn't waste time on it. If it is your debt and for an overdraft, then there is no CCA to request so no real way of stalling on that front.

If you are in Scotland, the debt will become statute barred after 5 years - 6 years in England.

I've figured out it's between 4 to 5 years old, I'm living in England, I've checked my credit report on experian and it has no details of any credit?!? Just details about what companies I told I was moving address, does this mean the debt is gone from my report or not? I do want to pay my debt but I have no details of the acc number or who it's with and how much etc? Which is why I checked my credit report! But do I hav to go through a third party or can I not deal with the original creditor directly?

As said Overdraft's are not covered by a CCA. If it were me I would ignore them until they contact you again, It looks like a Phishing excercise.
Wait until they come up with some more details you can work on.
They are confident enough of your identity to write to you? why should you have to contact them to verify anything. Its actually a breach of guidelines for them to write to people who's identities they are not sure off. (they do anyway hoping not to get caught out).

If you phone them at this stage expect a hard sell and an attempt to get more a month out of you than you would be happy with.

This also allows for time in the post.

This is their head office rather than all the multiple branches tc he also covers the Thames Credit part of the group.

Hope this helps some of you out as the OFT did give them guidelines to follow towards the end of last year. Good Luck

We received a letter today regarding the CCA request I've removed any personal details. (I hope this works )

Basically The text says

Dear Mr .....

We refer to your request for documentation/further information regarding your agreement with ....... under section 77 to 79 of the CCA.

Although we purchased the tight to recover the outstanding balance due under the agreement, as we are not the original creditor we do not hold the original documentation in this matter.

In order to obtain this, we will contact the original creditor, as we do wish to provide the information that you require, in accordance with the CCA 1974, in an effort to resolve this matter.

Whilst we endeavour to obtain documents within the prescribed time scales, due to the fact that we have to try to obtain documents from the original creditor we may be unable to do so, your account is on hold and has been removed from the collection process whilst we await the requested information.

Please note We have also cancelled the DD with the bank to make sure they dont get that payment!
