  • Thats right, now the account remains in dispute until,
    A. They provide the paperwork you requested.
    B. They decide to drop it.
    C. It goes on so long it becomes unenforceable anyway.

Look out for a raft of tricks to start and appear, like getting you to phone them, asking for extra proof of your identity etc.

    Keep us posted.
    Regards, Handy.

well prove it letter has been delivered so will await their response, am hoping for the same as last time which is they are unable to obtain copies of CCA and dropped it.

Its been almost 12 years since i heard anything from Barclays, and they are writing to me using my maiden name which I haven't used in 10 years. So i think the wisest thing for them to do is drop it, to be honest its making me sick with worry, I really don't know how they get away with this business and shame on the banks for selling on these alleged debts so far down the line.

will keep everyone updated - thanks again for everyone's help so far.

Wookiesgirl, maybe its possible that the debts have been bought off another company already, so there fore the debt was off the banks hands years ago, but has been passed around debt collectors for years! and this one has finally got hold of you! But either way I soooo wish we had known the info we do now, years ago! as we wouldnt have started paying them to begin with! we worked out over the years they have had over £700 out of us, and if we had been savvy we could have avoided paying anything, thats also including one that is already paid off, and the other one that cought up with the other half recently! Which we will also sent the CCA letter too, to see what happens there!

Wookiesgirl, if you have made no payment towards the debt or acknowledged it in writing then it will be statute barred. Stop worrying about this. They do have a right to try to collect the debt as technically it still exists, but they cannot enforce the debt - the most they can do is ask you to pay. Once you send them a SB letter, they are no longer allowed to even request payment from you. You have legislation behind you so please stop worrying about it.

CeeJayDee23, something else to bear in mind now that the debt is in dispute - under the ODT debt collection guidelines, a debt in dispute must not be passed on to another party, so you should not be hearing from anyone else until they supply you with the CCA.

Thankfully We have learnt this from reading these kind of forums, Well we posted the CCA request on 17th Feb so technically the 12+2 is up tomorrow, With the wording from their letter, I very much doubt they will come back with said documentation. For the fact they acknowledged our request with the reply they sent us, does that mean it gives them longer to gather the requested documentation?

The debt stays in dispute until they provide the paperwork.
This means they can do nothing to enforce the debt or to sell it on. They cant ask for payment or contact you.

As we know If they ever do produce the CCA the debt is SB. It would just be better if they ran up the white flag now.

Some people would advise to do nothing, me I would say give them a couple of weeks and send them a letter stating that they have had say an extra 20 days + and why haven't they produced the paperwork.
I have done this and the result was a letter from the DCA saying that in their opinion my alleged debt was statute barred so I wouldnt hear from them again.

    Cheers, Handy.

    Thanks handyman,

After reading on another forum thread the 12+2 days are working days which would put D-Day as 9th March!

    :beer::beer::beer::T MSE 2 AK 0 :rotfl:

While I'm not suggesting for a moment that this is people getting away with it, cos it isn't. A poor credit score can affect so many aspects of modern life. But the way these companies operate, scare tactics, half truths, down right lies and Bully boy tactics, especially when so many of us here were fed credit upon more credit. In some ways the financial institutions only have themselves to blame.

It's about time the Debt industry got a massive shake up, until then we have MSE and one another for help and advice.

The Folk I feel sorry for are those who don't find their way here.
So many must fall through the net, otherwise companies like AK would go out of business.

    Regards to all, Handy.
