MissMoney Penny - when you say 'most landlords' I do take that to mean I am included..........thats the bit I have the problem with. Out of interest how many LL's do you know? My problem with that statement is that it is generalised. i agree that LL's can be nightmare when they need to return the deposit. I am not one of those!! i have rented in the past and left the place in the state I took it - thus got all my deposit back.
You seem to be doing a lot of protesting about this. Are we getting the complete story? Would the tenants view of what happened while he rented your house, be the same as yours? You say the tenant has debt problems, but don't say that he owe you any money. I assume he didn't have debt problems when he paid your rent?
You are kidding yourself mate if you think that a there are not many bad landlords. My sister in law helps at the CAB and a large amount to their complaints are now about landlords behaving badly.
Just how much is this deposit you hold that doesn't even cover the removal of the rubbish? When we bought a 5 bedroom 3 reception room house, the seller had left a lot of their rubbish behind. It took a couple of rolls of black sacks to bag most of it and a call to the council to take away the large items that didn't fit into our 1 run to the local tip with the larger stuff.. Some councils remove large household rubbish for free. If the deposit is several hundred and you are going to get greedy and charge the price of a entire house move, then your tenant might just take legal advice and find out what you have been told here, that you don't have a signed inventory.0 -
To most of us it's understandable that Oki is "protesting". He has already said that the tenant had unpaid rent, and there are other unpaid bills at the property. Those on the forum who are LL readily help tenants who come on with queries but this thread is a LL asking for suggestions for help - don't hi-jack it.
Perhaps you need to read back through the thread, as it's about more than just a few piles of rubbish. Yes, there are good and bad amongst both LLs and tenants, but maybe you could try not to be quite so biased?0 -
He is owing me 2 months rent - I have £320 deposit. I am not trying to be a greedy landlord. As i have already said it is only a 2 bed terrace with a yard. The main issue is damage to internal doors, kitchen units, the carpets are covered in dog excrement that would need to be removed. The carpets were brandnew throughout before he moved in. I have all receipts for any purchases made for the house before and during his tenancy. I also have the boiler etc covered for repair should there be any problem.
I assume the tenant has debt problems based on the letters at the house - that were open and left among the rubbish. In saying that there was also a bank statement showing almost £9000 transferred to a solicitor. Which I am thinking may be a deposit on a house - I am looking into this.
I have found out that I will be covered for the majority of the costs throufh my landlord insurance. If I don't post the truth then the advice I am being given is of no use. It lies in my interest to be open and honest and get the best advice that I can.
Thanks tbs624 atleast there are some people on the forum happy to offer advice and not ready to judge. I do feel as though according to some I am the one who has done wrong for ever becoming a LL and that clearly all LL's are the scum of the earth just out to make a quick pound or several hundred as suggested in my case by some on the forum.0 -
any debt letters or utility bills that they have run up, make them all aware of his new address, you don't want his debts, let him deal with them, should teach him to do a moonlight flit.
this may not cover the cost of repairing and cleaning but satisfaction that he can run but not hide would be great. take legal advice and if you can take him to small claims court, if you find out he has another LL send them copies of the state he left the house in. evil yes.Life is about give and take, if you can't give why should you take?0 -

Having been told by some of the responsible landlords on here that he hasn't got a chance if he goes to court as he hasn't got a signed inventory, it now seems he is going to get a solicitor to write to the tenant, which appears to be an attempt to bully or deceive an individual that he would win in court. It also appears that if oki is holding a sizable deposit of several hundred pounds (although he still hasn't saisd how much it is and hopefully he put it in a deposit scheme if he renewed a contract from April this year) that he thinks he can charge the cost of a full house removal to clear out just the rubbish alone. Your quite happy with that course of action are you?0 -

if you read post 45 he does in fact say that the deposit was £320... at this time unedited...
more importantly, he'll have to pay someone to clean up the dog poop, fix the kitchen up, and not to mention the back rent that the tennant didn't pay, why should the tennant get away with owing him money...
i am a tennant, and although i'm on the side of tennants being allowed to have somewhere decent to live, i don't think it would ever be fair to ruin brand new carpets in a rented house with dog muck, or break off doors etc...
why don't you go and find someone else to 'bash' as all this guy is asking for is some advice.

He was a month in arrears and the deposit will not even cover removal of his rubbish.He is owing me 2 months rent - I have £320 deposit.
The removal of rubbish will not cost you £320.
You can go to the small claims court for the recovery of the rent arrears of 1 month or 2 months rent.0
