Hi and thanks all for your replies. The inventory is attached to the front of the tenancy agreement - so he read it all before he signed the contract. He would have had to read that page before signing at the end of the document. Could I argue the case based on that.
The thing is I know I will need to move on but am really angry that there are people out there who can do this and just get away with it. I have emailed insurance company and am waiting to hear from them. I am hoping I am covered under malicious damage.........watch this space. Oki0 -

I take it that you don't realise that fleas can be carried in on peoples clothes and then breed in house in corners of wallpaper and carpets, so your house might have been like that when you let it? Plus hedgehogs, cats and foxes all carry fleas and will be in the garden.

My estate agent cousin always tell their LLs that if they don't look after their property, then don't expect the tenant to look after it either.
Most LLs get the tenants their deserve.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

Just sort the house out - clean,repair,replace and prepare it for next let.
As for ex-tenant, don't waste a lot on legal, you may well not get it back. I had a very similar situation to you including the flea's. I still have the photo's in case. It's great in theory that you can sue the ex-tenant but in practice probably isn't worth the money and effort. Even if you can track the ex down ( you need a current address to serve ) the warning signs are, debt collector letters and unpaid utilities. He probably hasn't got the money so even if you get judgement you'll probably get nothing in practice.
Hi somerset - I think he bought the house he has moved into - he left an OPENED bank statment amongst the rubbish and it shows a transfer of approx £9000 to a solicitor. Not sure how he got the mortgage! I just need to find out if the house he lives in now was sold recently - not sure how any ideas?0 -

I think you might find that the tenant and yourself have to sign every page of the inventory.
Was the tenant in the house with you when he signed the contract, checking that every defect was listed on the inventory?RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

He would have got a mortgage as easily as a lot of BTLers and FTBers have over the last few years, until they credit crunch put paid to that. The banks handed out money like sweets, and any lie would get you a mortgage.
You can go onto the land registry site and pay £3 to download the deeds to the house, to see where the mortgage lenders have the property owner listed. If it is his name, then he owns the house. Not sure how long it takes LR to update their records though.
If he has recently bought the house, then he might be one of the last 100% or 125% mortgages and will not have any equity in the house and probably won't for a few years.
Remember:-
It is only worth suing people if they have money.

OKI I would start the ball rolling to money back off your ex-tenant, you may find he will freely admit that the house wasn't in the state he took it over in. If not you have the witness who signed the contracts. (can you get them back asap to see how house was left?)
Also you have on your side that he didn't give notice and he didn't pay rent up-to-date.
If the unsigned inventory is an issue it will be at court stage IF he defends himself. If you have photos pre him letting house, like EA details where it was for sale, you can back yourself up.

MissMoneyPenny - I don't appreciate your comment about LL deserving the tenants they get - My house had just be replastered, new kitchen, Ch system, carpets, bathroom - before this guy moved in! The tenant was in the house at the time of signing contracts and we went through room by room (2 bed terrace!). If there was ever a problem it was dealt with promptly!
