I have just recieved notification that Virgin have denied my request to claim PPI.
They have said that "PPI was applied to my account following my request on the application form"
They have enclosed a copy of the application form which shows I selected PPI. However at no point was I asked about pre-existing medical conditions.

Is there anything I can do?

Not to worry hun, more than likely a standard response.;)

When did you take out this policy hun ?

We will guide you from here.;)

    Hi M....many thanks for response..

You are right I did receive a fob off letter which I promptly replied to. I told them that I did not agree with their findings and had requested a SAR to enable me to investigate my claim further. I said that once I had received the SAR material and reviewed I would respond more fully. Hopefully by keeping the dialog going they will not have closed the case, as the complaints exec said he would close the case if he received no further communication from me.

Having listened to the phone conversations I'm absolutely convinced I was missold. Initially my partner was going to be the main applicant as I work for the NHS and have adequate cover (the adviser actually raised this himself), they quoted a repayment figure with PPI (never gave us a figure without ppi), also no mention of interest being whopped on top and also no mention of interest being paid for full term of loan. What's even worse though is during the loan application, the job my partner was about to start fell through, so they made me the main applicant and even though they knew I was covered for accident, sickness etc by the NHS they kept the PPI on AND issued me with a Statement of Needs document with answers to questions they had asked my other half !!!!!

Oooh it's good to rant sometimes. Anyway to cut a horribly long story short, I have put a letter together with my findings which will be flying off to them tomorrow.

Was just wondering how people actually worked out what they were due back as it makes me go cross eyed just thinking about it.

Many thanks for all your help and everyone else who gives advice - it is sooo much appreciated.

got a letter back from nemo
super quick as well as they only got my request letter yesterday

anyway it says the loan and PPI where arranged through a broker ocean finance. I thought that ocean had just put us in touch with nemo and taken a broker fee that shows on our loan agreement form
as sutch we need to take the complaint of mis selling PPI to ocean, but all our paper work is on nemo headed paper from the loan agreement form to the settlement figure

    Help!!!!

If they don't pay up then after receiving your final response from them you can definately get this looked into by the FOS and they will do all the workings for you. Its to put you back into the position you would have been in without the PPI so its the interest as well. If you post your figures on here and dates etc and APR and how many months and how many payments you have made then someone (Tiggrae perhaps) can take a look.

    Good luck.

just read this on the main site on the PPI reclaiming page

If the seller was acting as an appointed representative of the insurance provider, it will probably tell you to contact the provider instead. Use the address of the branch you visited for your first letter; any follow up can be sent to the head office if necessary.

do you think this means I should write to nemo head office as my first letter was sen to the customer service address

You still need to take your complaint to the firm that sold the PPI and loan to you. That being Ocean Finance. When was this taken out?? Was it the may 2006 one??

If it was then your complaint can be sent into the FOS if they don't come up trumps. Write a letter to Ocean for misselling and you have to give them 8 weeks for a response. This will have to have the wording of final response and then you can make your complaint to the FOS.

Its always the firm that actually sold the policy to you and not the lender if its different.

Its the agreement number of Nemo that you use in the claim for the PPI against Ocean Finance.

Here is the address for Ocean from the FSA register

    Pacific House
    Relay Point
    Wilnecote
    Tamworth
    Staffordshire
    B77 5PA
