    thanks for that maxdp. Are you saying then that FOS gave out info about you to the MBNA but didn't look into your complaint about them at first. I think i read somewhere where its the firms that tell the FOS to sod off if they think its not right for them to be looking into things so maybe FOS's hands are tied sometimes.

    I think they want to help some people out and cannot. Its like the wording a complaint to the FOS. I bet they have to then send it on to the company and then if you have not got it right then their solicitors can say "you are not allowed to intervene with this".

    No I Sent copy of Complaint form to MBNA that I had sent to FOS and they used that info. I think as we have discussed before the FOS are funded by Banks etc. Have also heard from another legal dept today that the FOS are working out refunds to suit the banks rather than us. I am aware that they can only suggest they settle but if they put two fingers up at FOS then I believe I am right in saying that court is the only action hmmmmm. They act as mediators (bit like going to counselling like marriage guidance if both sides do not agree they can only make recommendations).

    It is not fair though cause all the time we are waiting if your are financially stretched you then get yourself into a worse debt whilst waiting for them to get their finger out.:rotfl:

    I don't think that FOS can make them pay up only advise them to and if you took the matter to the courts after if they did not pay then i would bet 99% that the courts would side with the FOS and they would end up paying more anyway. Also i bet they are then blacklisted at the FSA too.

    Now you are making me paranoid about FOS too.(nothing new - already was).

    Sorry not meaning too at all. Think they are a very good institution for a lot of people but I reiterate to all reading this, check the figures. Think people think that just cause it FOS they do not make mistakes but they do. Am sure it will all work out for you now but it is like living in a twilight world. You must find it extremely difficult when you are giving people help and advice and theirs get things sorted and you are still waiting.

    Cant put any funny faces on here does not seem to be working are you having trouble too.:D

    With Firstplus as well we remortgaged to another comany during our time and had to request a deed of postponement. We rang them and asked for one to be sent to our mortgage provider and they said that until they had the actual offer they would not send. Our mortgage provider then wrote with a quote like thing and agreed a date for this to take place and FIrstplus would not release it. Its all on the tape and i am in tears asking for it and it took over 9 weeks. We had to employ a solicitor in the end as they would not work with us. Also all they kept saying was " we could perhaps help with a top up" and i kept saying your rate is 17% and theirs is 6%. They had us trapped.

    I know they are sharks. The only good thing about all this is that people are going to be more informed. If I put on here our debts at mom and how much we are claiming back it would make your hair stand on end. Am just hoping it all gets sorted out before we have to throw the towel in. You are doing something about it and not just letting them get away with it. That is all you can do. These people have us over a barrell and it just makes the problem twice as bad.

    Keep chin up you are doing a wonderful job on here helping and supporting people.

    Just popping out to pick daughter up.

    Quite agree they do that they hide behind legal stuff and paperwork and say you should have checked etc etc etc that is why I think that if they are awkward you have to challenge them and their paperwork. They get of on legalities well so can we what is good for the goose is good for the gander.;)

    Enough of my claims now and lets get back to helping others again. It makes me forget my own which is better for me and hopefully helpful to others too.:D

    I do it cause I truely enjoy helping others as I know what it feels like and its not nice thinking you're alone. We are all a family of PPI reclaimers me thinks.:D
