. Usually they can only go back 6 years as that is the time that business's have to keep records for.
Tigrrae would be best to advise you on this one through the courts. She may be on later.
Yes I agree very lucky for the FOS to look at the earlier one of 1992, so that's cool.;)
I have heard that court for these type of complaints are not that bad, and I don't think the other side turn up anyway, I may be wrong here, and like what Marshallka has said Tiggrae would be the one to advise you on the courts.;)
If I have no option, I will happily take this to court myself, and if you have any paperwork to back you it will ease the pressure.
See what Tiggrae says about this too hun.
Sorry to leave you to it again Marshallka.:o

The reasons I stated were that I was never asked of any previous medical conditions.
I was also told how much my paymenst would be with and without Payment protection. But when I said I'd have it without pp he said I couldnt have it without. My husband even remembers him saying it.
Only I am insured on the policy.
And now as you say I wasnt even aware of the fact that it was a single premium ( as I definately wasnt). But I didnt know that so I didnt put that in the letter. I wished I'd have spoken to you guys first....
I never settled any loans. We just went into the branch to top them up. But I never ever had any money back off anything. Plus my husbands name had to be on they said as they wouldnt lend me the money on the wages that I was getting so he had to take all his wages etc in too.
Thankyou so much for all this help. I just hope I've not messed it up for myself.
Cheers.
Loulou
Let us know how you get on.
Just a quick one, did the policy cover the full term of the loan??? Also did you get anything back when you topped them up and took new ones???
Good luck Loulou0 -
I have made a to Firstplus in respect of missold PPI In November 2007 after a couple of months tooing & froing I decided to involve the FOS . Whilst the FOS are doing their best and have agreed that my claim is valid it seems as though Firtsplus are using every tactic in th book to delay giving an answer. In the meantime I am paying the interest and priciple on the cost of the PPI policy and like everyone else at the moment I am struggling to make ends meet. Any suugestions on how I might progress this would be gratefully recieved.0

I really didnt know what we'd been sold. I cant find where it says if the policy covered the full term of the loan. I only have an A4 sheet of paper saying schedule on it with a few details on it. I cant find the 2006 loan agreement anywhere. Yet I have the 2003 on here.......I bet hubby has moved it ages ago. He calls it tidying up!! LOL
Would I need to send another letter to them as I've not given them the full details EG: regarding being sold the single premium? Do you think I would get any response if I e-mailed them?
Cheers Marshallka. You've given me a bit more confidence telling me what you have.

got letter back from tsb regarding mis-sold ppi.it says, thankyou for your letter.i am sorry that you feel the pp policy covering your agreement was mis-sold.it is important that we are made aware of any instance where our customers feel dissatisfied and i have, therefore, investigated the issues you have raised.
when you discussed the loan application and ppi with a member of our staff, you would have been provided with a leaflet summarising the key benefits and exclusions of the cover, that
leaflet also confirmed cover was optional.
only after you were given the opportunity to read the summary leaflet was the agreement document produced for signature.
this is my first letter,i will continue on next page soon.0 -

Hi there.
Have you actually explained your financial situation to the FOS hun ?
Maybe worth you doing this and maybe they can fast-track this for you, they may request some copies of evidence, and a copy of a bank statement will do.;)
Good luck !

If they have then perhaps you could let the FOS know of the delay and ask them to speed things up. There were two others that i know that were treated the same and although they did stall they eventually got it. One had a hamper delivered in the meantime too (LOL). It was someone named Laini who is on here every now and again and she may be able to help if she logs on.0 -
letter carried on from first letter.
the finance agreement document that was signed would have shown that ppi insurance was purchased when entering into this agreement and shows the full cost of that policy.by signing this agreement, you confirmed that you had read, understood and accepted the terms and conditions of our agreement and wished to purchase ppi as specified.
furthermore, following our acceptance of the agreement, the full policy terms and conditions were automatically sent to you at your home address.as well as confirming the policy eligibility and exclusions, those terms also stated that if you were not entirely satisfied with the level of cover being provided,it could be cancelled in full and without cost by writing to us within 30days of date of this agreement.having checked our records,no such request has been received.
in the abscence of any documentary evidence in support of your claim,i regret to advise that we are unable to uphold your claim that the pp policy was mis-sold.as the agreement with us is now settled and you have had the benefit of cover for the period of the agreement,no refund of the sums paid for ppi will be made.
i am sorry if this is not the response you were hoping for, however,i trust i have confirmed our position.
what happens now, need some help here please.0 -
Just to let you know I did receive some post today - only just read it (working today!!Long Summer holidays over!!!)
Any way FP have replied that although they have got the amount of dates term of PPI was incorrect, their offer of £775.27 is an enhanced rebate as the remaining period of cover is only 12 months - they do not say in their letter about reduced monthly payments, so it's in the hands of FOS now!!!DEBT free:j0
