Sorry - I didn't make myself very clear (too cross!).

The Financial Ombudsman Service have just turned down my claim. I have 2 weeks to get back to them with more evidence but as I don't have any I'm not sure what to do.

Hi there goonlord, sorry I have just got on here properly and have not had the chance yet to read through all the threads, so in case I have missed this hun, if you don't mind me asking, "what was the reason why the FOS turned down your claim", was it because these were not covered by the FSA or GISC etc when you had taken out this policy ?

There are still avenues to get through first so please don't worry at this stage, like our Marshallka says there's always the small claims court, but lets make sure we have covered everything first before taking this route.;)

Again not had the chance to get through all threads yet, who was the product taken with and when hun ?;)

    Cheers
    Di.

If unsuccessful regarding the mis selling side, there is always the "unfair rebate/settlement" if you feel you were ripped off for this, if it wasn't for out Marshallka and Tiggrae I doubt I would have bothered, but many of you will have read my post yesterday from the FOS to confirm that I maybe eligible to complain on these grounds as a NEW complaint.;)

Of course not to forget to mention if you settled the product after Jan 2005 where firms were then under jurisdiction (covered by the FOS).

Check your paperwork company number folks and onto the FSA register, this will confirm this.;)

  • Hello Di,

I was claiming for two products taken out with HSBC when I took out my mortgage in 2000. One was level term assurance that I paid until 2002 before cancelling. The other is an income protection plan which I paid until 2006. I didn't want either!

Claim turned down on the level term assurance and awaiting answer on the income protection plan.

To be honest, I'm not keen to go through the courts because at the end of the day, it boils down to my word against theirs so it would probably be a waste of time...

Hi hun sorry about the delay in getting back to you, my phone has been red hot lol.

Okay HSBC were regulated to my knowledge 2001 but I will double check this one for you.

You should have no problem in trying to reclaim on the insurance as I am aware that it can be any insurance product just as long as you have not made a claim.

Have you all the documents to these still, the agreements etc ?

Will see what I can find out for you and get back.;)

    Thanks for this maxdp.;)

    Interesting this.

    Will re-read again later.

It now makes me wonder though, between me and hubby we have 3 complaints in with the FOS at present regarding Credit Card PPi, we had these products just after 2001 with Lloyds TSB, we settled these when we had a mortgage and borrowed a little more on this to pay off these in 2003, wonder where we would stand with this as they are settled, because we still believe we were not treated fairly with this product and so on, the same as the complaint we have in about the ppi.

To me we still been deprived of this settled or not, because we still had to borrow more credit to settle this credit......  .

What are your thoughts folks ?;)

    Hi Di

As you I am sure are aware I have claims in with FOS and various banks for PPI etc etc but also have a claim against a Loan which I am pursuing at mom through Solicitors as unenforceable. I know this subject causes discussion on here but I feel that my OH was forced into this loan (instead of an increase of £500 on overdraft for a short period.) and this then spiraled out of control with 3 further loans and 5 credit cards all sold with PPI. So If this claim is successful then it will help settle the debts resulting from this bad advice from the bank.

I am all for going down this line if you feel you have been badly advised. Saying that I do prefer sorting out my own stuff through FOS etcf. At the end of the day you have to do what you have to do. These banks hide behind not paying out PPI etc cause you should have read and understood the paperwork. Well if they had read and understood their paperwork we would not be able to claim against them.:D

As promised in my above post I thought I would check out HSBC for you on the register, there are so many of them, so if you still have the paperwork for these, check out the company reg number, check on this link if any of them match, it will then show you who are and were authorised from various dates.
