I have recently succesfully reclaimed over £3000 from M&S loans for PPI which was mis-sold to me on a loan. I did this ususing 2 template lettes and the whole process was very straightforward.
I am not having such luck with a reclaim for PPI on a credit card I took out with HFC Beneficial in 1992. They sent me their final response in Nov 2007 and I then took my case to the FOS who have been very helpful but say that as neither side are able to produce any evidence they are unable to take this any further. I am considering taking this up through the courts and have used MCOL successfully for reclaiming credit card charges. I'm feeling a bit wobbly about this but don't want to give up as it is a great deal of money even if I only go back 6 years. Has anyone any thoughts or experince with anything like this? thanks0 -

I think there is a £1 charge for this (can't be sure) or you could request a subject access request which is all the data that they hold about you for £10. This would then give you more idea.

You send the letter to whoever actually sold the policy to you. (the business that sold it if you went through a broker).0 -

Usually they can only go back 6 years as that is the time that business's have to keep records for.
Tigrrae would be best to advise you on this one through the courts. She may be on later.0 -
marshallka wrote: »Right Loulou, you first need to write the first template letter on here for misselling on both these loan ( or if another then that as well). They are both in date for the FOS should they knock you back. Send it off with as many reason as you have and don't forget to send it reocrded delivery so you have a proof of posting and delivery. You then have to give them 8 weeks for a full and final response to it. If you need any more help then give someone a shout. They were single premiums too.

Hi Marshalka. Thanks for the info. I posted a recorded letter on monday but I only had the info for the 2003 policy as I couldnt find the other one, but I did say there was another taken out in 2006.
If it was a single premium then is that a reason for it being mis sold? I did put in my letter that I was the only person insured even though my husbands name is on the policy. I have noticed that on my 2003 policy it says first customer name and address and my name and address.
Then underneath, second customer name and address. By putting first and second customer, is this their way of being able to say its not a joint loan?
I think I'm losing the will to live.
We went into the halifax for each loan and the insurance was through them as well. I think its in Ireland.0 -

I would perhaps add that the insurance premiums were single premiums and you did not realise that you had to pay interest on these as well as the loan too. Also there are various other reasons listed on the claim letter about medical things and so like and if they asked about these.
Also when you settled each loan to have the top ups did you get any of the insurance back from the other loans??
ALso it still will be joint loan i think as both names are on the paperwork. Although usually from experience on here only one is insured.0 -

Hi Marshallka. I'm sorry to be a pain, its not easy when you dont have a good head for long words and jargon. LOL
The reasons I stated were that I was never asked of any previous medical conditions.
I was also told how much my paymenst would be with and without Payment protection. But when I said I'd have it without pp he said I couldnt have it without. My husband even remembers him saying it.
Only I am insured on the policy.
And now as you say I wasnt even aware of the fact that it was a single premium ( as I definately wasnt). But I didnt know that so I didnt put that in the letter. I wished I'd have spoken to you guys first....
I never settled any loans. We just went into the branch to top them up. But I never ever had any money back off anything. Plus my husbands name had to be on they said as they wouldnt lend me the money on the wages that I was getting so he had to take all his wages etc in too.
Thankyou so much for all this help. I just hope I've not messed it up for myself.
Cheers.
