hi it wasn't section 5 on the Unfair Contract Terms I should have put Section 3 - General Terms & Conditions - Termination of Benefit & Cover on the Payment Protection Plan - it's the last paragraph which states ' If you settle your loan or cancel your policy before the end of this period you will receive a partial refund of your premium. This will not be proportional and may be substantally less than the amount originally paid.'

If that isn't an unfair contract term then I don't know what is !!!!
I wrote this a while back as i thought it was very unfair. What about the term i asked about yesterday where it states at their discretion they will either take your payments off the loan or the interest. Is that one ok.... I don't really understand but it seems like they can do what they like to you after you have signed.

hmmm not really up on the loans side of things so can't really comment, I only look at the PPI - but it's a cautionary note - ALWAYS READ THE SMALL PRINT -

Have not got round to doing this yet, but aiming to get it done this afternoon once the inlaws have disappeared lol....... , anyway I do have some update news from the FSCS to confirm delivery of the application form, here goes: (Twopart Limited is that of brokers e-loan).

    FSCS Ref:
(Please quote this reference when contacting us)

    Dear Mr and Mrs

I can confirm that we have received the completed Application Form, together with the enclosed documentation. We are currently reviewing this claim in line with our rules, as set by the Financial Services Authority, and we will contact you again when our assessment of the claim is complete.

We are currently investigating the solvency position of Twopart Ltd to decide whether we can declare the firm to be ‘in default’ under our rules (i.e. we are satisfied that it is unable, or likely to be unable, to meet the claims against it). This opens the way for us to pay compensation to those investors who have eligible claims against the firm.

Once our investigation into the solvency position of the firm is complete, and if we are able to declare Twopart Ltd ‘in default’, we will then go on to consider the specific facts of your claim to decide whether we can compensate you under our rules.

It is difficult to give an exact timescale as to when we will be in a position to write to you about your claim. Reviews into the solvency of firms are, by their very nature, time consuming, as we are dependent on receiving information from third parties, over whom we have no jurisdiction. As soon as these investigations are finalised we will contact you again.

Any personal information you provide us with will be held by the Scheme in accordance with our data protection policy, which is on our website or available on request.

If you have any further questions about this matter please e-mail me, or telephone us on 020 7892 7300 and ask to speak to our Customer Services Team. This was the email sent to Click yesterday, think I may have already added it here - can't remember ?

    Account number:

    Dear Mr XXXXXX

I am very disappointed by your decision regarding my letter sent to Mr XXXXXX the director of the company which was investigated as confirmed by yourself, and the conduct of directors in avoiding this complaint.

If you are not prepared to reconsider, I will have no alternative but to inform the OFT Licensing Department as I do believe this is acceptable fit and proper conduct of the directors in accordance with the CCA Amendments 2006.

I hope to hear from you within 7 days of this email, thank you.

    Kind Regards
